LEVÂİC KULLANICI SÖZLEŞMESİ / TERMS OF SERVICE 09.03.2026

1. SÖZLEŞMENİN KABULÜ VE TARAFLAR

“LEVÂİC”  şirketine ait mobil uygulamamız ya da internet sitemiz üzerinden gerçekleştireceğiniz tüm aktiviteler öncesi burada belirtilen kullanım koşullarını, bu koşulların öncüleri Güvenlik ve Politikası, Güvenlik ve Şikayet Bildirimi, Çerez Politikası, Güvenlik İpuçları ve Topluluk Kuralları ile gelen özel koşulları kabul ettiğinizi beyan etmiş olursunuz. 

Ülke geneli değişiklik, hizmetlerde değişim, revize, alınan geri dönüşler, ek gereksinimin belirlenmesi, şirket politikalarında değişiklik gibi sebeplerle “LEVÂİC”, kullanım koşullarında değişiklikler yapma hakkını saklı tutar. Değişiklik yapılması durumunda, daha önceden sözleşmeyi kabul etmiş Kullanıcılarimiz değişiklikler hakkında bilgilendirilir.

Bu Sözleşmenin en güncel versiyonu, sözleşmeler veya profil altında ve aynı zamanda www.levaic.com adresinde ve LEVÂİC uygulamasında yayınlanacak olup en güncel versiyonunu düzenli olarak kontrol etmeniz gerekmektedir. En güncel versiyon geçerli olan versiyondur. Değişiklikler hak veya yükümlülüklerinizi etkileyen önemli değişiklikler ise, (ilgili kanun uyarınca bir engel olmadığı takdirde) değişikliklerden en az 30 gün önce sizi Hizmet üzerinden bildirim veya e-posta yolu dahil olmak üzere uygun yollardan haberdar edeceğiz. Değişiklikler geçerli olduktan sonra Hizmeti kullanmaya devam ederseniz, tadil edilmiş Sözleşmeyi kabul etmiş sayılırsınız.

İşbu Kullanıcı Sözleşmesi (“Sözleşme”) 8 the Green STE D, Dover, Delaware, County of Kent, 19901 Amerika Birleşik Devletleri adresinde mukim Levintelligence, INC. (“Hizmet Sağlayıcı”) tarafından www.LEVÂİC.com internet sitesi ve çeşitli mecralarda kullanıma sunulan “LEVÂİC” uygulaması (“LEVÂİC Uygulaması”) aracılığıyla sunulan  danışmanlık hizmetlerinden faydalanmak isteyen ve bu kapsamda LEVÂİC Uygulaması’na Kullanıcı olan gerçek veya tüzel kişiler (“Kullanıcılar”) arasında LEVÂİC Uygulaması’nın kullanım şart ve koşulları düzenlemek amacıyla düzenlemektedir.

2. SÖZLEŞMENİN KONUSU

İşbu Sözleşme, Kullanıcı’nın LEVÂİC Uygulaması’nda belirtilen danışmanlık hizmet paketlerinden yapacağı seçim doğrultusunda; ihtiyaç duyduğu alanlardaki uzman veya klinik psikologlar, aile ve çift terapistleri ile uzman yönetici koçlarının (“Danışman”) aracılığıyla görüntülü, sesli ve yazılı iletişim kanalları üzerinden alacağı danışmanlık hizmetleri, kişisel gelişim içerikleri (GROWTH) ve diğer networking ve deneyim odaklı hizmetlerden (“Hizmetler”) faydalanmasına ilişkin şart ve koşulları ile, karşılığında ödenecek ücrete yönelik tarafların hak ve yükümlülüklerini düzenler. LEVÂİC, kullanıcılarına kişisel gelişim, iyi-oluş ve ilişki yetkinliği geliştirme alanlarında danışmanlık temelli hizmetler sunar. 

Bu veri aktarımı, 6698 sayılı KVKK, AB GDPR ve ABD Delaware Privacy Law uyarınca yalnızca açık rıza kapsamında ve hizmet amacıyla sınırlı olarak yapılır. Hizmet Sağlayıcı, LEVÂİC Uygulaması aracılığıyla kullanıcıların yukarıda belirtilen içerik ve hizmetleri alabileceği dijital bir danışmanlık platformu sunmaktadır. 

3. KULLANIM ŞARTLARI ve HİZMET SAĞLAYICI’NIN YÜKÜMLÜLÜKLERİ

3.1 LEVÂİC Uygulamasında profil oluşturmak ücretsizdir.

3.2 Kullanıcılar, profil oluştururken beyan edilen isim, adres, telefon, e-posta gibi her türlü bilgilerinin güncel, doğru ve eksiksiz olduğunu kabul ve taahhüt etmekte olup, Hizmet Sağlayıcı söz konusu bilgilerin doğruluğunu ve güncelliğini kontrol etmekle yükümlü değildir.

3.3 Söz konusu uygulama kullanıcıları, uygulama üzerinden profil oluştururken işbu Sözleşme’yi onayladığını ve uygulamadan yararlanmaya başladığı andan itibaren işbu Sözleşmeye uymayı kabul ve taahhüt etmektedirler.

3.4 Hizmet Sağlayıcı uygulama aracılığı ile sunduğu hizmetlerinin sürekliliğini sağlama veya mevzuata uyum sağlanması amacıyla işbu Sözleşmeyi tek taraflı olarak değiştirme ya da tadil etme hakkına sahiptir. Bu şekilde değiştirilmiş veya tadil edilmiş Sözleşme, yayınlandığı andan itibaren geçerli olacaktır.

3.5 Hizmet Sağlayıcı, LEVÂİC Uygulaması’na Kullanıcı olmak isteyen kişileri sebep göstermeksizin Kullanıcı olarak kabul etmeyebilir veya Kullanıcıten çıkarabilir, uygulamayı kullanmaktan ve erişimden men edebilir, profilleri askıya alabilir, geçici olarak kullanımı durdurabilir. Aynı şekilde Kullanıcılar de dilediği zaman tamamen sistemden ayrılma hakkına da sahiptir.

3.6 LEVÂİC Uygulaması aracılığıyla Kullanıcılar ve Danışmanlar’ın vermiş olabilecekleri; bilgi, tavsiyeleri, ya da önermiş olabilecekleri konulara ilişkin veya yaptıkları görüşmeler sırasında iletilen iletilere yönelik olarak Hizmet Sağlayıcı’nın bir sorumluluğu bulunmamakta olup, bu sebeple oluşacak zarar ve kayıplardan Hizmet Sağlayıcı hiçbir koşul altında sorumlu olmayacaktır.

3.7 LEVÂİC Uygulaması aracılığıyla  danışmanlık hizmeti alan Kullanıcılar’in profil bilgileri ile seans sırasında Danışmanlar tarafından kaydedilen bilgiler, Kullanıcılar’in tercihlerine göre bir sonraki seans için saklanabilmekte veya silinebilmektedir.

3.8 Kullanıcılar’in profil bilgileri ile görüşme sırasında Danışmanlar tarafından kaydedilen bilgiler, Kullanıcı Kullanıcıliğini sonlandırana kadar Hizmet Sağlayıcı ve Danışman tarafından gizlilik prensibi çerçevesinde saklanacaktır.

3.9 Hizmet Sağlayıcı LEVÂİC Uygulaması’na Kullanıcı olanlar için kesintisiz erişim için çalışmaktadır. Ancak mevzuat uyarınca veya sair çeşitli sebeplerden dolayı Kullanıcılar uygulamaya erişimi geçici veya sürekli olacak şekilde askıya alınabilir, sınırlandırılabilir ya da sona erdirilebilir.

3.10 Danışmanlık Görüşmeleri: Yüz yüze görüşmenin kısıtlandığı ya da uygun olmadığı durumlarda psikolojik sağlık açısından etkililiği kanıtlanmış bir uygulama olarak online psikolojik danışmanlık/ terapi/Koçluk uzun yıllardır tüm dünyada kullanılmaktadır. Çalışmaların başarısı danışanın danışmanı ile işbirliği yapması ve açık iletişim kurmasına bağlıdır.

3.10.1 Psikolojik Görüşme, Terapi ve Psiko Eğitim Hizmetleri :

LEVÂİC, bir “geleneksel olmayan psikoterapi ortamı” olarak kabul edilen internet aracılığıyla Danışmanlık ve Terapi hizmetinin, Türk Psikologlar Derneği Etik Yönetmeliği hükümleri çerçevesinde ve 50 dakikalık görüşmeler halinde Kullanıcılare sunar. Danışmanlık ve Terapi görüşmeleri birbirini takip eden görüşmeler bütünüdür. Gerekli uzmanlıklarını ve yetkinlikleri tamamlamış klinisyen ve/veya Aile ve çift terapileri, ilişkiler üzerine uzmanlaşmış psikolog ve sosyolog olan ruh sağlığı profesyonellerinden oluşan LEVÂİC ekibi bu hizmeti verir. Danışmanlık ve Psikoeğitim görüşmeleri yansıtma, öğrenme yolları, araştırma içerir, gerektiğinde yaşam uygulama önerileri içerebilir, danışmanın bireyin sağlığına uygun gelecek yönlendirme,önerilerinde bulunabilir. Danışanın geçmiş yaşantısına değinilir. Görüşmeler terapötik olabilir. Bu görüşme düzenine uymak veya uymamak Kullanıcınin kendi takdirindedir. LEVÂİC sorumluluk kabul etmez.

LEVÂİC in bu hizmeti öncelikle Kullanıcınin kendine olan kalp ateşini yakmayı aynı zamanda Kullanıcınin zor ve kolay zamanlarında güvenli, sürdürülebilir ilişkiler yaratabilmesini desteklemeyi amaçlamaktadır. 

3.10.2 Koçluk Görüşmeleri :

LEVÂİC, Koçluk hizmetlerinin uluslararası onaylı (ICF) International Coach Federation/ Uluslararası Koçluk Federasyonu Etik Yönetmeliği hükümleri çerçevesinde ve 50 dakikalık görüşmeler halinde Kullanıcılare sunar. Online ve yüz yüze gerçekleştirilen koçluk; eğitim ve danışmanlık adı ile LEVÂİC’de sunulan hizmetlerden biridir. Tavsiye ya da terapi olmayan koçluk ve eğitim hizmetleri, Kullanıcı’nin mesleki hayatındaki hedeflerine, iş, misyon, vizyon, hedeflerine ya da genel hayatındaki kişisel hedeflerine yönelik olabilir. Hizmet sürecindeki çalışmalar; misyon, vizyon ve değerlerin açıklığa kavuşturulması, güçlü yönlerin saptanması, yeni fikirlerin üretilmesi, yol haritasının oluşturulması, eylem planlarının saptanması, işlem mekanizmalarının belirlenmesi, aydınlatıcı sorular sorulması, güçlendirici taleplerde bulunulması ve Kullanıcı’in aksiyon almaya teşvik edilmesi gibi konuları içermekte olup bunlarla sınırlı değildir. Ayrıca, bu hizmetlerin hedeflerinden biri de Kullanıcı’nin ihtiyacı olduğu konularda farkındalık artırıcı gerekli bilgileri sağlamak ve kendisine yol haritası çıkarmasını sağlamaktır.

Koçluk görüşmeleri birbirini takip eden görüşmeler bütünüdür. Koçluk görüşmesi tavsiye içermez, bireyin araştırmak istediği konuları beraber araştırır, konu hakkında bireyin kendi yaratacağı çözümleri araştırır, destekler ve takip eder. Tüm bunları yaparken yansıtma yapar ve Kullanıcı ile anlaşarak yeni öğrenme yolları arar. Bu görüşme düzenine uymak veya uymamak Kullanıcınin kendi takdirindedir. LEVÂİC sorumluluk kabul etmez.

LEVÂİC’in bu hizmeti öncelikle Kullanıcınin kendine ve ideal beliğine ulaşmasına dair kalp ateşini yakmayı aynı zamanda bu yolculukta Kullanıcıye, hayat bakışına ve öğrenmelerine yoldaş olmayı amaçlamaktadır. 

• Ortak Sorumluluk:

LEVÂİC tüm Danışmanlık, Koçluk, Psikoeğitim ve Terapi görüşmelerinin faydalı olması, ortak sorumluluk kapsamındadır. Bu noktada Kullanıcı’nin sorumluluk sahibi olması önemlidir: Kullanıcı dürüst olmalı, ne istediğini söylemeli, danışmanlık ilişkisinde neyin işe yaradığı neyin yaramadığı konusunda Danışmanına bilgi vermelidir. Koçluk görüşmesinde diğer danışmanlık görüşmelerinden farklı olarak Kullanıcı görüşmenin gündemini belirlemelidir ve Koç, görüşmelerden maksimum fayda sağlanabilmesi için, cesur, açık sözlü ve  koşulsuz olarak yapıcı olmayı taahhüt eder.

• Görüşmenin Zorluğu :

Klinik ve terapi görüşmelerin dinamikleri diğer danışmanlık görüşmelerden çok daha derindir ve farklı işler. Terapist Kullanıcınin içgörüsünü zenginleştirmek için etik değerler içerisinde kabul gören teknikler uygulayabilir, yetkinlikler sergileyebilir. Koçluk görüşmelerinin dinamikleri diğer görüşmelerden farklıdır. Kullanıcınin sürecine göre doğrudan taleplerde bulunabilir veya Kullanıcıye meydan okuyabilir. Kullanıcı kendini rahatsız, kötü hissedebilir. Doğrudan talep/meydan okumanın amacı Kullanıcınin, hedeflerini gerçekleştirmeye yardım etmektir. Bu talep/meydan okumaları kabul edebilir, karşı bir teklifte bulunabilir ya da reddedebilir. Kullanıcı, gerekirse reddetmeyi tercih ederse, Kullanıcınin işine yarayan bir yöntemi Koçu ile birlikte seçmeyi taahhüt edecektir.

3.10.5 Görüşme Erteleme ve İptal

Kullanıcı, satın aldığı veya kupon ile sahip olduğu danışmanlık görüşmesini 24 saat öncesine kadar erteleyebilir, iptal edebilir. 24 saatten daha az kalan süre için değişiklik kabul edilmemektedir. Özel durumlarda Kullanıcınin görüşme yapacağı danışmanı ile durum ayarlaması yapılabilinir, danışmanın inisiyatifindedir, zorlama yapılmaz.

Görüşmeye katılım gösteremeyeceğiniz durumda, görüşme saatinden en az 24 saat öncesine kadar görüşme tarihinin değiştirilmesini talep etme hakkına sahipsiniz. 24 saat öncesine kadar ertelenmeyen görüşmelerin ücretini ödemeniz gerekmektedir.

3.10.6 Görüşme Kuralları ve Onam Bilgisi

• Mahremiyet :
  1. Görüşme sırasında paylaşılanlar Kullanıcı izin vermediği sürece, servis sağlayıcılardan kaynaklanabilecek sorunlar dışında Kullanıcı danışman arasında kalacaktır. Ancak istismar, intihar riski, siz veya yakınlarınızın zarar görmesi gibi durumlarda Kullanıcı ilgili bilgileri izniniz olmadan mesleki etik ilkeleri ve yasalar doğrultusunda ve zorunluluk doğduğunda sadece yetkili mercilerle ve mahkemelerle paylaşılacaktır.
  2. Bilimsel açıdan değerli olduğu düşünülen veriler, kimlik bilgileri gizli tutularak akademik amaçla kullanılabilir.
  3. Danışman, Kullanıcı ile kurduğu iletişime ait herhangi bir veriyi, mahremiyetini bozacak şekilde, üçüncü kişi, kurum veya online-offline medya araçları ile paylaşmayacağını taahhüt eder. Online terapiye dâhil olmak, yukarıdaki koşulların ve oturumların herhangi bir bölümünü kaydetmeme veya başkalarının önceden anlaşma yapmadan oturumu dinlemesine (telefon veya başka bir cihaz veya araçla) izin vermeme koşullarının kabulü olarak anlaşılacaktır.
  4. Görüşmelerin Kullanıcı mahremiyetini kişisel verilerin korunması kanunu çerçevesinde korunacağını taahhüt eden bilgilendirilmiş onam formunu onaylanması durumunda, Kullanıcı olarak danışmanın mahremiyetini sağlayacağınızı onaylanmış olunur. Önceden anlaşma yapılmadığı takdirde Kullanıcı ve Kullanıcı dışındaki herhangi bir kişinin oturumu herhangi bir araçla dinlemeyeceğini, görüşmeleri herhangi bir araçla kayıt altına almayacağını kişisel verilerin korunması kanunu kapsamında koruyacağını taahhüt etmiş olur.
  5. 6698 sayılı Kişisel Verilerin Korunması Kanunu nezdinde Başvuru Formu’nda Kullanıcınin doldurmuş olduğu “Başvuru Form Soruları” başlıklı alanın özel nitelikli veri kapsamına girmesi sebebiyle LEVÂİC tarafınca korunmaktadır.
• Görüşme Süresi ve İletişim:
  1. Danışmanlık görüşmeleri 50 dakika sürer. Görüşme süresi iki tarafça gerekli görüldüğü takdirde 50 dakikayı aşabilir ya da daha kısa sürebilir. Danışman, elinde olmayan sebeplerle görüşmeye geç gelebilir, bu durumda görüşme sürenizi uzatarak 50 dakikayı tamamlar. Görüşmeye Kullanıcı geç geldiğinde danışman görüşme süresine ekleme yapmaz, görüşme normal zamanında biter.
  2. Danışman, kendi inisiyatifinde ve gerekli gördüğü durumlarda 15’er dakikalık ücretsiz görüşme , tanışma görüşmesi gerçekleşebilir, bu sürenin kısalığı veya uzunluğu danışmanın inisiyatifindedir.
  3. Danışman, kendi inisiyatifinde gerekli gördüğü durumlarda platformda mesaj yolu ile de görüşme sağlayabilir.
  4. Görüşme süresince Kullanıcı rahatsız edilmeyeceğinden ve bulunduğu odada mahremiyete sahip olduğundan, bulunduğu odaya açılan kapının kapalı olacağından emin olmalıdır.
  5. Kullanıcı görüşme esnasında telefonla görüşmemelidir.
  6. Danışman ve Kullanıcınin iletişimlerinin saygı çerçevesinde olması beklenmektedir. Bir tarafın saygıyı aşan davranışında diğer taraf görüşmeyi sonlandırma hakkına sahiptir.
  7. Görüşmelere Kullanıcı, bilinçli olmasını engelleyecek durumlarda katılmamalıdır. (Alkol, madde veya ilaç etkisi gibi) Görüşmede Kullanıcınin herhangi bir şekilde bilinçli olmasını engelleyebilecek madde veya alkol etkisinde olduğunun anlaşılması durumunda danışman, görüşmeyi sonlandırabilir. Böyle bir durumda tüm sorumluluk Kullanıcıye aittir. Ücret iade edilmez, görüşme telafisi yapılmaz.
• Ortak Sorumluluk : Koçluk ve Terapi görüşmelerinin faydalı olması, ortak sorumluluk kapsamındadır. Bu noktada danışanın sorumluluk sahibi olması önemlidir: Danışan dürüst olmalı, ne istediğini açıkça belirtmeli, danışmanlık ilişkisinde neyin işe yaradığı neyin yaramadığı konusunda danışmanına bilgi vermelidir. 
• Danışmanın Öznelliği :
  1. Danışman, etik kurallar dahilinde özel görüşme kriterlerine sahip olabilir. (Yiyecek yenmemesi, içecek içilmemesi, tütün kullanılmaması ve benzeri gibi Bunları Kullanıcıye görüşme öncesinde veya görüşme esnasında belirtebilir. Kullanıcıden, danışmanın gerek duyduğu kurallara duyarlı olması beklenmektedir. Belirtilen kurallar ile ilgili bir soru olması durumunda Kullanıcı, danışmanından sorusunu yanıtlamasını beklemelidir.
  2. Görüşme planlaması her bir danışmana ve Kullanıcıye göre değişiklik göstermektedir. Genellikle ilk görüşmede görüşme planı danışman ile Kullanıcı beraber oluşturmalıdır. Görüşme gelişmelerine göre planlamada değişiklikler yaşanabilir. Kullanıcıden, Danışman ile oluşturduğu görüşme planlamasına uyması beklenmektedir.
• Danışman  LEVÂİC GROWTH içeriklerini, Blog hizmetlerini, Levâic Talks ta gerçekleşecek atölye/seminer hizmetleri, Levâic takip Koçluğunu Kullanıcıye tavsiye edebilir;
• LEVÂİC GROWTH’da yapılan testlerin süresi, testin niteliğine göre değişmektedir. Kullanıcı bu konuda açık bir şekilde bilgilendirilmelidir.
• Gerekli gördüğü takdirde uzmanımız durumunuzu değerlendirmek için bir psikiyatri uzmanı ile görüşmenizi önerebilir.
• Danışmanınıza; psikolojik danışma süreciniz, kendi yaşantınız vb. ile ilgili veya danışmanınızın eğitimi ve yeterliliği hakkında da sorular sorabilirsiniz.

3.11 İlişki Yetkinliği Analizi Görüşmesi Hizmeti(RCA):

3.11.1 LEVÂİC, alanlarında uzman aile ve çift terapistleri, psikologlar, koçlardan oluşan eşleştirme analistleri ile “İlişki Yetkinliği Analizi”  görüşmesi gerçekleştirerek Kullanıcıyi ve Kullanıcınin ilişki ihtiyaçları ile yetkinlikleri tanımaya çalışır. Danışmanlık, koçluk veya Terapi görüşmelerinden ayrı ve (ICF) International Coach Federation/ Uluslararası Koçluk Federasyonu Etik Yönetmeliğine uygun gerçekleşir.  Görüşmeler 50 ve/veya  50 ila 120 dakika arasında sürer. 

3.11.2 LEVÂİC uygulmasının İlişki Yetkinliği Analiz Hizmetinden her kullanıcı yararlanabilir.

3.11.3 LEVÂİC uygulmasının İlişki Yetkinliği Analiz Hizmetin sonunda rapor verilir. Bu rapor doğrultusunda  Kullanıcılar kendilerine uygun Psikolojik Görüşme, Psikoeğitim ve Terapi Hizmetleri, Koçluk Görüşme Hizmetleri, GROWTH Programı Hizmetlerinden yararlanmak için rehber niteliğindedir.

3.12 GROWTH Programı Hizmeti:

LEVÂİC, abone olan tüm Kullanıcılarıne GROWTH Hizmeti vermektedir. GROWTH Merkezi, Kullanıcılarine psikoloji biliminin ışığında bütüncül hizmet vermek amacıyla kayıtlı eğitimler içerir. GROWTH e-learning programı için kullanıcı sözleşmesine eklenebilecek maddeleri aşağıda bulabilirsiniz. Bu maddeler, programın doğasını, kullanımını ve kullanıcıların sorumluluklarını açıkça belirlemeye yardımcı olur: Eğitim Materyallerine Erişim: GROWTH programına kaydolan kullanıcılar, program tarafından sunulan eğitim materyallerine erişim hakkına sahiptir. Bu materyaller, yalnızca kişisel ve eğitim amaçlı kullanılabilir. Kullanıcı Lisansı: Kayıtlı kullanıcılar, GROWTH materyallerini kişisel kullanım için indirebilir, görüntüleyebilir ve yazdırabilir. Ancak, bu materyallerin herhangi bir şekilde çoğaltılması, dağıtılması veya ticari olarak kullanılması yasaktır. GROWTH programında sunulan tüm içerikler, materyaller ve kaynaklar telif hakkı ve fikri mülkiyet kanunları ile korunmaktadır. Bu içeriklerin telif hakkı sahibi olan LEVÂİC ve/veya lisans verenleri tarafından sağlanmıştır. GROWTH programının içeriğini yalnızca yasal ve etik kurallara uygun şekilde kullanmayı taahhüt eder. Herhangi bir yasa dışı, ahlaka aykırı veya telif hakkı ihlali içeren kullanımdan kullanıcılar sorumludur. GROWTH programına kaydolurken sağlanan kişisel verilerin korunması, LEVÂİC’in gizlilik politikasına tabidir. Kullanıcılar, kayıt sırasında sağladıkları bilgilerin doğruluğundan sorumludur. LEVÂİC, GROWTH içeriğini ve kullanım koşullarını önceden haber vermeksizin değiştirme hakkını saklı tutar. Kullanıcılar, bu değişikliklerden haberdar olmak için düzenli olarak kullanım koşullarını gözden geçirmelidir. Kullanıcılar, GROWTHve içeriğini, yalnızca eğitim, gelişim ve öğrenim amaçları için kullanmayı kabul eder. Herhangi bir ticari amaç için kullanımı yasaktır. LEVÂİC, GROWTH  programının kullanımından kaynaklanabilecek her türlü doğrudan veya dolaylı zarar, kayıp ve masraflardan sorumlu tutulamaz. Kullanıcılar, programın kullanımı sonucu ortaya çıkabilecek riskleri kabul eder.

3.13Levâic Talks Etkinlik Seminer Hizmeti:Levâic, yalnızca bireysel danışmanlık hizmetleri sunmakla kalmaz; aynı zamanda Levâic Talks çatısı altında çevrim içi ve çevrim dışı olarak gerçekleşen psikoeğitim seminerleri, atölyeler, paneller ve topluluk buluşmaları ile kullanıcıların ilişkisel farkındalığını desteklemeyi amaçlar. Bu etkinlikler, uzman yürütücüler tarafından hazırlanmakta ve Levâic’in etik ilkeleri çerçevesinde yürütülmektedir. Kullanıcılar, mobil uygulama veya internet sitesi üzerinden kayıt oluşturarak etkinliklere katılım sağlayabilir. Etkinlik süresince paylaşılan içerikler yalnızca iç hizmet süreçlerinde değerlendirilmekte olup, kullanıcı gizliliği ve güvenliği öncelikli olarak korunmaktadır.

3.14Levâic Takip Koçluğu Hizmeti: Levâic Takip Koçluğu hizmeti, kullanıcıların danışmanlık sürecinde edindikleri kazanımları hayata geçirmelerini desteklemek, dijital bir yol haritası üzerinden gelişimlerini takip etmek ve hedef odaklı ilerlemelerini sağlamak amacıyla yapılandırılmıştır. Bu hizmet; bireye özel takip planı, periyodik koç yönlendirmeleri, hedef hatırlatıcıları ve gelişim önerileri sunar. Koç ile kullanıcı arasındaki iletişim, çevrim içi görüşmeler veya telefon ile sağlanabilir. Takip Koçluğu, psikoterapi yerine geçmeyen; ancak bireyin kendini tanıma ve hedefe odaklı hareket etme becerisini güçlendiren bütüncül bir destek sistemidir.

3.15 GROWTH, Levâic Talks Etkinlik ve Seminer Hizmeti, Takip Koçluğu, Online Danışmanlık, İlişki yetkinliği Ölçme Hizmeti  servislerini kullanmak için kayıt olarak herhangi bir suçtan ötürü hüküm giymediğinizi, hakkınızda cinsel taciz içerikli herhangi bir şikayet yapılmadığını kabul ve garanti etmiş olursunuz. LEVÂİC kullanıcılarının suç geçmişini araştırmakla beraber fazla bilgi araştırma hakkını saklı tutar, dilediği zaman halka açık kayıtlara erişerek kullanıcılarının geçmişini kontrol edebilir. Nefret suçu, tecavüz, aile için şiddet, taciz, dolandırıcılık ya da diğer suçlardan hüküm giymiş kişiler bu uygulamayı ve sunduğu hizmetleri kullanmak için uygun kişiler değildir. Eğer bir kullanıcının herhangi bir suçtan hüküm giymiş olduğu halde Kullanıcı olduğu tespit edilirse, Kullanıcı ücret iadesi yapılmaksızın derhal sonlandırılır ve uygulama yöneticilerini kasten yanılttığı düşünülüp ilgili kurumlara yasal işlem yapılması adına suç duyurusunda bulunulur. 

3.16 LEVÂİC danışmanlık kombinasyonları servisleri aracılığı ile diğer kullanıcılarla sağladığınız tüm çevrimiçi ve çevrimdışı etkileşimlerin risk ve sorumluluğu size aittir. Eşleştirme servisi aracılığı ile iletişim kurduğunuz ve tanıştığınız kişilerle olan münasebetlerinizde kişisel güvenliğinizi sağlamak adına tüm önlemleri bizzat almanız gerektiğini kabul edersiniz.

3.17 Kullanıcılar, Levâic Talks etkinliklerinde bir araya geldikleri diğer Kullanıcıların iletişim bilgilerini isteme, sosyal medyadan veya diğer mecralardan takip etmesi yasaktır;  hiçbir şekilde zorlama, taciz ve tehdit dahil, rahatsız edemezsiniz. 

3.18 Sayfa içerikleri kullanıcıları bilgilendirme amaçlı düzenlenmiştir ve gerekli görülen hallerde uyarı yapılmaksızın güncellenebilir. 

3.19 Kullanıcı, bu uygulmayı belirli bir amaç için kullanırken tarafımızdan, üçüncü taraf, tavsiye edilen buluşma lokasyonu çalışanı, sahibi veya eşleştirilen Kullanıcı tarafından herhangi bir olumsuzluğa maruz kalınmayacağının bir garanti vermediğini kabul eder.

4. PROFİL VE ENTEGRASYONLAR

Kullanıcılarin, LEVÂİC hizmetlerinden yararlanmak için öncelikle profil bilgilerini veya başvuru formunu doldurması gerekmektedir. Kullanıcılar, profil bilgilerinde veya başvuru formunda belirtilen bilgilerin doğru ve güncel olduğundan emin olmalıdır. LEVÂİC, Kullanıcınin bilgilerini, Kullanıcınin doldurduğu formlarda belirttiği bilgilerden edinecektir.

Kullanıcı profilinde, paylaşılacak bilgileri profil bilgilerinde veya başvuru formunda belirtilmiştir. O bilgiler dışında paylaşma tercihi edilen bilgilerden, profil sahibi olan Kullanıcı sorumludur. Kullanıcı, Profilini güçlü bir şifre ile koruduğundan emin olmalıdır. LEVÂİC, çalınan şifrelerden kaynaklanan kayıplardan sorumlu değildir, Kullanıcınin mevcut şifresine erişimimi yoktur. Güvenlik nedenleriyle Kullanıcıye yalnızca şifresini nasıl sıfırlayacağına dair talimatlar sağlayabilir. Kullanıcı, kendisine ait olmayan bir hesaba erişim veya bu hesapla ilgili bilgi talep edemez. Kullanıcı, profiline bir başkasının erişim sağladığını düşünüyorsa LEVÂİC’e bildirmelidir. Kullanıcı, LEVÂİC’in Kullanıcıden topladığı bilgiler ve bunları nasıl kullandığı hakkında daha fazla bilgi için Güvenlik ve Politikası ‘nı inceleyebilir.

LEVÂİC, kişisel gelişim alanlarında hizmet sunan bir dijital danışmanlık platformudur.

5. HİZMETLERDE DEĞİŞİKLİKLER

Ülke geneli değişiklikler, hizmetlerde değişim, revize, alınan geri dönüşler, ek gereksinimin belirlenmesi, şirket politikalarında değişiklikler gibi sebeplerle LEVÂİC, kullanım koşullarında değişiklikler yapma hakkına sahiptir. Bu değişikliklerin kapsamına yeni özellik ve hizmetlerin eklenmesi, var olan hizmetlerin özelliklerinde yapılan ekleme ve çıkarmalar, ve bazı var olan hizmet ve özelliklerin çıkarılması dahildir. Bu değişiklikler hakkında bilgilendirmeler, LEVÂİC kullanıcılarına yapılır. Kritik ve esaslı değişiklikler yapılması durumunda ise kullanıcılara güncel sözleşme koşulları sunulur ve kabul eden kullanıcılar ile sözleşmeler yenilenir. Var olan modüllerin kapsamında toplanabilecek veriler; katılım esnasında iletilen duygu ve düşünceler, eğitmen veya koç notları, gelişim puanları, içerik tüketim kayıtları ve koç önerileri doğrultusunda yapılan eylemlerle sınırlıdır. Bu veriler yalnızca hizmetin kişiye özel planlanması ve gelişim takibi için kullanılır.

Yapılan değişiklikler ya da başka bir sebep ile Kullanıcıliğini sonlandırmak isteyen kullanıcılar bu hakka sahiptirler. Kullanıcı, Kullanıcıliğini sonlandırdığında hesabını ve şahsıyla ilişki kurulabilecek tüm verileri LEVÂİC’in kalıcı olarak silebileceğini onaylar ve kabul eder. Kullanıcı olunan pakete ve dahil edilen hizmetlere göre Kullanıcıliğin sonlandırılmasına bağlı olarak ödeme ve iade koşulları farklılık göstermektedir. LEVÂİC, Kullanıcıye seçtiği pakete Kullanıcı olmadan önce o paketin tüm özelliklerini, koşullarını, iptal ve ücret iade koşullarını açık bir şekilde sunmaktadır. Kullanıcılar, paketlere Kullanıcı aşamasında sunulan evrakları ve bilgileri dikkatle okur ve muhafaza eder. Kullanıcılar, konu ile ilgili diğer soruları için “Sıkça Sorulan Sorular” ve  “LEVÂİC Davranış Kuralları” sayfasını ziyaret edebilir ya da help@LEVÂİC.com adresinden LEVÂİC ile iletişime geçebilir.

Kullanıcı, Kullanıcıliğini sonlandırması halinde gizlilik ve güvenlik önlemleri dahilinde Kullanıcı İptali veya Kullanıcı Dondurma Sonrası Koşulları’nı okumalı ve kabul ettiğinin onayını vermelidir. Bu koşullar, Kullanıcılari ve diğer kullanıcıları korumaya yöneliktir.

6. KİŞİ GÜVENLİĞİ

LEVÂİC, güvenli ve sürdürülebilir ilişkileri topluma yayma misyonu ile ilerleyen ve Kullanıcı seçiminden sunulan hizmetlere, tüm aşamalarda bu misyona uygun adımlar atmaya özen gösteren bir şirkettir. Kullanıcılarin zarar görebileceği durumları minimize etmeye dair çabamız, maalesef %100 garanti sağlamaz ve LEVÂİC, hiçbir Kullanıcınin kefili ya da referansı olamaz. Reşit olan bireylerden oluşan LEVÂİC topluluğunda her birey kendinden sorumludur. Kullanıcılar, Kullanıcılarin güvenliğini arttırma amacıyla LEVÂİC’in hazırladığı “Güvenlik İpuçları”nı ve LEVÂİC Davranış Kuralları”nı dikkatlice okuduklarını; özellikle Kullanıcılarin yüz yüze görüşme kararı verdiğinde veya çevrimiçi iletişimlerinde paylaşacakları bilgileri ve alacakları kararları önemle seçeceklerini kabul ederler.

7. LİSANS HAKLARINIZ VE HAKLARI KAYBETME

LEVÂİC Kullanıcısi olarak kabul edilmeniz ve LEVÂİC topluluğunun bir parçası olmanız durumunda LEVÂİC tarafından sağlanan kullanım lisansına sahip olur ve lisans haklarından faydalanırsınız. Fakat LEVÂİC kural ve koşullarına aykırı davranışlar lisansınızın iptaline sebep olabilir. LEVÂİC Davranış Kuralları ve aşağıda listelenen kurallar LEVÂİC lisansından faydalanabilmenizin ön koşullarıdır.

• LEVÂİC mobil uygulama, internet sitesi, mail ve mesaj yolu ile sizin hizmetinize sunulan ve telif hakları LEVÂİC üzerinde olan herhangi bir ürün, hizmet ya da içeriği fikri mülkiyet kanununa aykırı kullanmayın. LEVÂİC tarafından yazılı izin almadığınız sürece kopyalamayın, çoğaltmayın, paylaşmayın ve intihal yapmayın. Sistemde herhangi bir manipülasyon ve değişiklikte bulunmayın.
• LEVÂİC tarafından toplanan verilere izinsiz erişim sağlama girişiminde bulunmayın. Teknik verilere ve programlama ara yüzüne erişimde bulunmayın, kopyalamayın ve paylaşmayın. Manuel ya da otomatik herhangi bir veri casusluğu yöntemi denemeyin.
• LEVÂİC tarafından hazırlanan herhangi bir ürün, hizmet ya da içeriği şirket onayı olmaksızın ticari bir amaçla kullanmayın.
• LEVÂİC’e özel tasarı, içerik ve ürünleri izinsiz kullanmayın. Bu tasarı, içerik ve ürünleri, LEVÂİC’e ait olmayan bir kişi, kurum veya site için yönlendirici olarak göstermeyin ve kullanmayın.
• Kendi fikir ve düşüncelerinize LEVÂİC’i referans olarak göstermeyin. Yazılı onayımız olmadığı sürece LEVÂİC onayı aldığınızın beyanında bulunmayın.
• LEVÂİC şirketinin size sunduğu hizmetleri ve bilgileri, şirket dolayısıyla diğer kullanıcılar hakkında edindiğiniz bilgileri üçüncü taraf uygulamalarla paylaşmayın, başka uygulamalarda kullanmayın.
• LEVÂİC hizmet ve özelliklerini, aksatacak ve sistemi bozacak eylemlerde -manuel ya da otomatik- bulunmayın. LEVÂİC hizmetleri içinde kötü amaçlı yazılımları -malware- kullanmayın.
• LEVÂİC’e ait herhangi bir hizmete zafiyet taraması yapmayın. Güvenlik açıklarının tanımlanması, sınıflandırılması ve önceliklendirilmesi hakkında bilgi edinmeye çalışmayın. Sistem güvenliğine tehdit oluşturacak girişimlerde bulunmayın.
• Sözleşmenin her bir kuralına uygun davranın. Uygun davranmayanları lütfen bize bildirin. İşbu sözleşmeye uyulmadığı takdirde sözleşme iptal edilir ve yasal işlemler başlatılır.

8. ÜCRETLENDİRME, ÖDEME, İPTAL VE ERTELEME KOŞULLARI

Ödemeleriniz alındıktan sonra bir yanlışlık olduğunu düşünüyorsanız bilgi için bizimle iletişime geçebilir ya da direkt itirazda bulunabilirsiniz. Bilgi talebi ve itirazınızı LEVÂİC üzerinden, ödeme için kullanılan aracı üzerinden ya da ödeme yapılan banka üzerinden bildirebilirsiniz.

Tarafınızca yapılmış kendi bankanızdaki otomatik ödeme talimatınızda değişiklikler -kart bilgileri, talimat süresi gibi- yapabilir ve dilediğiniz zaman iptal edebilirsiniz. Otomatik ödeme talimatını iptal etmeniz durumunda, bakiye yetersizliği ya da ödeme yapmamanız durumunda hizmet almanıza devam etmenize rağmen ödeme yapılmıyorsa bunların size ait resmi borçlar olduğunu ve ödeme alınamaması durumunda hukuki süreçlerin başlatılacağını kabul edersiniz.

Tarafınızca yapılan değişiklikler, faturalandırma üzerinde de yansıtılacaktır. Bilgileriniz güncellenir ve fatura kesim tarihlerinde değişikliğe yol açabilir. Ödemenizi kredi veya banka kartı üzerinden gerçekleştiriyorsanız, kartınızdaki geçerlilik tarihi gibi güncelleme ve yenilenmeler kart sağlayıcınız tarafından bize bildirilir ve bilgileriniz güncellenir.

Ödeme tarihlerinin belirlenmesinde birçok faktör etkin olabilir. Bağlantılı mali kurum, ilgili banka ya da diğer bir kart sağlayıcı ile var olan sözleşmelerinize göre ödeme tarihi belirlenecektir.

Kullanıcı abonman paketlerinizi, danışmanlık görüşme randevularınızı erteleme etme ya da satın aldığınız görüşme paketinizde değişiklik yapma hakkına sahipsiniz. Paket ve danışmanlık görüşmeleri başka bir zmaana erteleme ve değişikliği için prosedürü takip etmelisiniz. Bu adımlar takip edilmediği takdirde sizden herhangi bir değişiklik ve iptal talebiniz bize ulaşmamıştır ve hizmet size verilmeye devam edecektir. Websitesini/Uygulamayı telefonunuzdan silmeniz bu talebinizi gerçekleştirmeyecektir. Başarılı Kullanıcı iptali veya değişikliği gerçekleştiği takdirde dönem başında anlaşılan süre kadar hizmetlerden yararlanmaya devam edebilirsiniz. Yeni dönemde ise pakete Kullanıcıliğiniz yenilenmeyecektir.

Bu süreci gerçekleştirmeden, ödemenizi herhangi bir yolla geri çekmeniz ve ödemeyi iptal etmeniz halinde Kullanıcıliğiniz iptal edilecektir. Ödemeniz sırasında LEVÂİC tarafından size sağlanan fatura, geri çekme ve iptal etme durumlarında değiştirilir ve düzeltilir

8.1 Ücretlendirme Koşulları

İşbu Sözleşmede belirtilen Hizmetler karşılığı ödenecek olan ücret LEVÂİC websitesi/uygulaması’nda her bir danışmanlık görüşmesi ayrıca görüşme paketleri olarak Danışmanların profillerinde belirtilmektedir. Kullanıcılar, seçeceği paketlerde ve Danışmanlar için belirtilmiş olan ücreti, paketi seçtiğinde ve Danışman ile yapacağı görüşme randevusu alırken kredi kartı aracılığıyla ödeyecektir.

LEVÂİC, görüşme bazında ve Kullanıcı tiplerine göre abonelikler sunan bir Danışmanlık Sitesi/Uygulamadır.

• Basit Kullanıcı : Sadece “Danışmanlık Hizmeti” sunulan Kullanıcı tipidir. Abonelik yoktur. Seçilen danışmanlık görüşmesi randevusu seçilip ücreti ödenerek satın alındığında otomatik başlar.  LEVÂİC, bu ücreti dilediği zaman değiştirebilir. Farklı ülkelerdeki fiyatlandırmalar değişiklik gösterebilir ve gerçek ücretler, ikamet ettiğiniz ülkeye bağlı olarak yerel para biriminize çevrilebilir. Bu hizmet sadece Danışmanların verdikleri danışmanlıklardan yararlanma sunar. Danışmanlık ücretleri danışmanın 50 dakika için belirlediği görüşme ücretidir, İlişki Yetkinliği Analiz Görüşme ücreti sabüt 100 dakikadır ve sabit ücret üzerinden işlemektedir.
• LEVÂİC Deneyim : “Danışmanlık Hizmeti” ile “GROWTH Hizmeti” sunulan Kullanıcı tipidir. LEVÂİC Deneyim Kullanıcı seçildiğinde ücretli ve ücretsiz gelişim çalışmalarından yaralanır. Seçilen ücretli gelişim çalışmaları için belirlenen ücret ile istenen danışmanlık görüşmeleri randevuları seçilip ücreti ödenir.  LEVÂİC, ücretini, gelişim çalışmaları ücretlerini ve danışmanlık görüşmeleri ücretlerini dilediği zaman değiştirebilir. Farklı ülkelerdeki fiyatlandırmalar değişiklik gösterebilir ve gerçek ücretler, ikamet ettiğiniz ülkeye bağlı olarak yerel para biriminize çevrilebilir. Bu hizmet sadece Danışmanların verdikleri danışmanlıklardan yararlanma sunar. Gelişim çalışmalarının uzunlukları içeriklere göre değişkenlik gösterir. Danışmanlık ücretleri danışmanın 50 -100 dakika için belirlediği görüşme ücretidir.

8.2 Ödeme Koşulları

LEVÂİC uygulaması Kullanıcılarine göre ihtiyaç duyacakları kişiselleşmiş hizmetler için farklı ücretlendirmede bulunabilir. Ödeme, STRIPE / Payoneer ödeme sistemi tarafından satın alma onayı ile kredi kartınızdan tahsil edilecektir. LEVÂİC’de otomatik yenileme ve kredi kartı bilgilerini tutma yoktur. Kullanıcılar danışmanlık paketlerini bir kere alırlar, abonmanlık paketlerini aylık , üç aylık, altı aylık ve bir senelik olarak yenilerler. Bir kullanıcı, deneme veya otomatik yenileme süresinin sonunda abone OLMAMAYA karar verirse, kullanıcı Basit Kullanıcı statüsüne indirilecektir. 

8.3 İptal ve Erteleme Koşulları

LEVÂİC’in hizmetlerinde iade işlemleri kesinlikle gerçekleştirilemez. Bu hizmetleri Kullanıcı satın almadan önce Kullanıcınin iade hakkının olmadığı Kullanıcıye bildirilir ve bu sözleşmeyi Kullanıcınin onaylaması halinde yapılan satın alım talebi onaylanır. Bu Kullanıcınin onayı verdiği satın alımlar için nihaidir. Kullanıcı, yelikten çıkmak isterse hiçbir ücret iade edilmez.

LEVÂİC Sitesi/ Uygulamasında satılan görüşmeli danışmanlık hizmetleri randevu sistemi üzerinden gerçekleşmektedir. Randevu değişikliğini veya paket iptali 24 saat öncesine kadar ücretsiz yapılabilmektedir. Kullanıcılar satın alma sırasında kendilerine gönderilen e-posta ile değişiklik bildirimi ile bu işlemleri gerçekleştirebilirler. Danışmanının başka uygun zamanına randevu değişikliği gerçekleştirilebilinir.

LEVÂİC Sitesi/ Uygulamasında içerik satın alımları ilgili modüllerden ve profil kısmından gerçekleşmektedir. 

LEVÂİC platformu, duygusal zeka gelişimi, ilişki yetkinliği analizi ve kişisel dönüşüm odaklı içerik ve danışmanlık hizmetleri sunar.

Bu belgeyi kabul eden her kullanıcı, aşağıdaki koşulları da kabul etmiş sayılır:

-Danışmanlık randevusu satın alındığında ücret iadesi yapılmaz, aynı danışmandan aldığınız görüşme randevunuzu 24 saate kadar aynı danışmanın başka uygun bir tarihine erteleyebilirsiniz.

-Bir danışmandan aldığınız görüşmenizi başka bir danışmanın görüşmesi yerine saydıramazsınız, sistem buna uygun değildir.

9. DANIŞMAN’IN HAK VE YÜKÜMLÜLÜKLERİ

9.1 Danışman, LEVÂİC Uygulamasında özel danışman profil bilgilerini doldurarak bu belirttiği bilgilerin doğru olduğunu ve LEVÂİC Uygulamasında Kullanıcılar’e  danışmanlık hizmeti vermeyi kabul ve taahhüt etmektedir.

9.2 Danışman, ilgili mevzuat hükümlerine uygun olarak LEVÂİC Uygulaması üzerinden Kullanıcılar’e hizmet verecek olup, Kullanıcılar ile yapmış olduğu görüşmeler çerçevesinde koçluk görüşmelerinin Kullanıcı için yeterli olmadığını tespit etmesi halinde Kullanıcı’yi LEVÂİC’de danışman olan terapiste yönlendirecektir. Danışmanlar Kullanıcılar ile yapmış olduğu görüşmeler çerçevesinde psikoterapinin Kullanıcı için yeterli olmadığını tespit etmesi halinde Kullanıcılar’i psikiyatriste yönlendirecektir. LEVÂİC Uygulaması zaman, mekan ve ekonomik olarak yüz yüze terapi ve koçluk alma imkanı olmayanlar için danışmanlık hizmeti sunmakta olup teşhis, tanı, tedavi amacı içeren bir tıbbi tedavi hizmeti değildir. Danışman, LEVÂİC Uygulaması kapsamındaki görüşmenin uygun olmadığı ve/veya yarar sağlamadığını tespit etmesi halinde hizmeti sonlandırma hakkına sahiptir.

9.3 LEVÂİC Uygulaması’nın kullanımı sırasında Danışman tarafından eklenen her türlü bilgi, doküman, hizmet, yazı, ifade, dosya, görüntü vs. kaynaklara ait yasal sorumluluk Danışman’e aittir.

9.4 Online Danışmanlık, İlişki yetkinlikleri ve çeşitli ölçme görüşmeleri, Growth gelişim videoları, Levâic Talks ve Takip Koçluğu hizmetleri, terapötik müdahale yerine geçmez. Bu içerikler, bilgilendirme ve gelişim amaçlı olup, tıbbi veya psikolojik tanı koymak ya da tedavi sağlamak amacı taşımaz.

10. KULLANICILAR’İN HAK VE YÜKÜMLÜLÜKLERİ

LEVÂİC, topluluk kurallarında yazılanların kontrol ve denetimini düzenle ve özenle sağlar. Fakat reşit olan bireylerden oluşan topluluğumuzda her birey kendinden sorumludur. LEVÂİC, hiçbir Kullanıcınin referansı değildir. LEVÂİC kurallarına uymayan Kullanıcılar, sonuçlarından da kendileri sorumludur. LEVÂİC kurallarına uygun olamayan davranış, tutum, profil veya içerikler tespit etmeniz durumunda lütfen LEVÂİC ilgililerine bildirin.

10.1 Kullanıcılar, 18 yaşından büyük olduğunu ve profil oluştururken beyan edilen isim, adres, telefon, e-posta gibi her türlü bilgilerinin güncel, doğru ve eksiksiz olduğunu kabul ve taahhüt etmektedirler. Kullanıcılar’in söz konusu bilgilerine yönelik çelişkili durumların tespiti halinde veya bilgilerin eksikliği ve/veya doğruluğundan emin olunamadığı durumlarda, Danışmanlar’in görüşmeyi sonlandırma ve Kullanıcılar’i LEVÂİC Uygulaması’na giriş haklarından men etme hakları bulunmaktadır.

10.2 Kullanıcılar, hesaplarının Kullanıcı ismi ve Kullanıcı şifresi gibi giriş bilgilerini üçüncü kişilerle paylaşamaz, hesaplarına üçüncü kişilerin girmesine izin veremez. Kullanıcılar, eşleştirme, networking ve danışmanlık hizmetleri vasıtası ile yaydığı, yayınladığı ve erişilebilir hale getirdiği bilgi ve içerikten, aynı zamanda kayıtlı diğer Kullanıcılar ile olan etkileşim ve paylaşımlarından yalnızca ve tamamen tek başlarına sorumludur. 

10.3 Kullanıcılar, LEVÂİC Uygulamasına kayıtlı olarak hizmet veren tüm Danışman’lardan dilediği danışmanı seçme veya değiştirme hakkına sahiptirler. Ancak Hizmet Sağlayıcı, Danışmanlar tarafından sağlanacak hizmetin kalitesi ya da uygunluğu garanti etmemekte olup, bu konudan sorumlu tutulamaz.

10.4 Kullanıcılar, Hizmet Sağlayıcı’nın Danışmanlar tarafından sağlanan içerikleri kontrol etmekle, bu içerik veya içeriğe konu mal ve hizmetle ilgili hukuka aykırı bir faaliyetin ya da durumun söz konusu olup olmadığını araştırmakla yükümlü ve sorumlu olmadığını kabul, beyan ve taahhüt ederler. Kullanıcılar, hizmetin sunulmasından kaynaklanan tüm sorumluluğun ilgili Danışman’a ait olduğunu kabul, beyan ve taahhüt ederler.

10.5 LEVÂİC Uygulaması’nın kullanımı sırasında Kullanıcılar tarafından eklenen her türlü bilgi, doküman, hizmet, yazı, ifade, dosya, görüntü vs. kaynaklara ait yasal sorumluluk Kullanıcı’nin kendisine aittir.

10.6 Kullanıcılarin, LEVÂİC Uygulamalarındaki, herhangi bir bilgiyi veya malzemeyi kullanımı tamamen kendi sorumluluğundadır, bu nedenle LEVÂİC tarafından sorumluluk kabul edilmez. Bu uygulama ve websitesi aracılığıyla sunulan herhangi bir ürün, hizmet veya bilginin, kullanıcının özel gereksinimlerini karşıladığından emin olmak kullanıcının sorumluluğunda olacaktır.

10.7 Kullanıcılar, işbu Sözleşme’yi kabul ederek LEVÂİC Uygulaması hizmetlerinden faydalanma isteğini beyan etmekte ve hizmetlerin sınırlarının farkında olduklarını kabul ve beyan etmektedirler.

11. LEVÂİC’DE KULLANICININ KAZANIDIĞI HAKLAR

11.1 Kullanıcılar bir hesap oluşturarak LEVÂİC Hizmet üzerinde paylaştığı, yüklediği, gösterdiği veya görülebilir olarak işaretlediği (toplu olarak, “paylaşımlar”) veya diğer Kullanıcılare gönderdiği (toplu olarak, “İçerik”) bilgilere ev sahipliği yapmak, bunları saklamak, kullanmak, kopyalamak, göstermek, çoğaltmak, uyarlamak, düzenlemek, yayınlamak, değiştirmek ve dağıtmak için LEVÂİC’e tüm dünyada geçerli, transfer edilebilir, alt lisanslanabilir, telif hakkı olmayan bir hak ve lisans verir. LEVÂİC’in Kullanıcınin içerikleri için lisansı inhisari olmayan bir lisans olacaktır ancak Hizmetin kullanımıyla oluşturulan ikincil çalışmalar hususunda LEVÂİC’in lisansı inhisari olacaktır. Örneğin LEVÂİC, İçeriklerinizin bulunduğu Hizmet ekran görüntüleri için inhisari bir lisansa sahip olacaktır. Ek olarak LEVÂİC’in İçeriğinizin Hizmet dışında kullanılmasını önleyebilmesi için, diğer Kullanıcılar veya üçüncü taraf hizmet sağlayıcılar tarafından Hizmet içinden edinilen İçeriğinizin ihlale yol açan kullanımları konusunda Kullanıcı adına hareket etmesi için LEVÂİC’i Kullanıcılar yetkilendirir. Bu, bilhassa İçeriklerinizin üçüncü taraflarca Hizmet dışından alınması ve kullanılması durumunda uygulanabilir hukuk ile uygun olarak Kullanıcı adına uyarı göndermek için yetkiyi içerir, ancak bir zorunluluk değildir. Kullanıcı içeriklerine olan LEVÂİC lisansı, geçerli yasalar (örneğin bu yasalar tarafından tanımlı bir şekilde Kullanıcı kişisel bilgilerini içeren herhangi bir İçerik için kişisel veri koruması ile ilgili yasalar) kapsamındaki Kullanıcı haklarına tabidir ve Hizmetin işletilmesi, geliştirilmesi, sunulması, ve iyileştirilmesi ile yeni hizmetlerin araştırılması ve geliştirilmesi gibi sınırlı amaçlar içindir. Kullanıcınin yerleştirdiği veya LEVÂİC’e Hizmet üzerinde yerleştirmek için izin verdiği herhangi bir içerik, diğer Kullanıcılar tarafından görüntülenebilir ve Hizmeti ziyaret eden veya ona katılan (diğer LEVÂİC Kullanıcılari tarafından paylaşılan İçeriği edinen kişiler gibi) herhangi bir kişi tarafından görüntülenebilir.

11.2 Kullanıcı, LEVÂİC hesabının oluşturulması üzerine Kullanıcınin gönderdiği tüm bilgilerin doğru ve gerçek olduğunu, İçeriği Hizmet üzerinden yayınlama ve LEVÂİC’e yukarıdaki lisansı verme hakkına sahip olduğunu kabul etmektedir.

11.3 Kullanıcı, Hizmet’in bir parçası olarak yayınladığınız herhangi bir İçeriği LEVÂİC’in izleyebileceği veya inceleyebileceğini anlamakta ve kabul etmektedir. LEVÂİC’in tek başına vereceği karara göre bu Sözleşme’ye aykırı olan veya Hizmet’in itibarına zarar verebilecek olan herhangi bir İçeriği kısmen veya tamamen silebilir.

11.4 Çerezlerden Gelen Bilgiler: LEVÂİC, talep ettiğiniz deneyimleri sağlayabilmek ve hakkınızda bilgi toplamak için çerezler, web işaretçileri, pikseller, yerel paylaşılan nesneler ve benzer teknolojileri kullanabilir. LEVÂİC’in çerezlerden topladığı bazı bilgileri ve bunları nasıl kullandığını Kullanıcı kontrol edebilir. Daha fazla bilgi için lütfen Çerez Politikası’nı inceleyin.

11.5 Kullanıcılar, LEVÂİC Müşteri hizmetleri temsilcileri ve danışmanlarıyla iletişim kurarken saygılı ve nazik olacağını kabul eder. LEVÂİC, Kullanıcınin LEVÂİC müşteri hizmetleri temsilcilerinden herhangi birisine veya diğer çalışanlara karşı davranışının herhangi bir zamanda tehditkar, rahatsız edici veya saldırgan olduğunu hissederse, Kullanıcınin hesabını derhal sonlandırma hakkını saklı tutar.

11.6 Kullanıcı, LEVÂİC’in Hizmet’i kullanmasına olanak sağlamasının karşılığında LEVÂİC’in, iştiraklerinin ve üçüncü taraf ortaklarının Hizmet’e reklam yerleştirebileceğini kabul eder. Kullanıcı, LEVÂİC Hizmeti hakkında LEVÂİC’e tavsiyeler veya geri bildirim göndermekle LEVÂİC’in bu geri bildirimleri size bedel ödemeden herhangi bir amaçla kullanabileceğini ve paylaşabileceğini kabul eder.

11.7 LEVÂİC’in kanunların gerektirdiği hallerde, Kullanıcı tarafına yapılan anlaşmanın yerine getirilmesi için veya aşağıdaki durumlarda olduğu gibi erişim, saklama veya ifşanın gerekli olduğuna iyi niyetli bir şekilde inanılan hallerde; Kullanıcınin hesap bilgilerine erişebileceğini, bunları muhafaza edebileceğini ve ifşa edebileceğini kabul edersiniz: (i) yasal sürece uymak; (ii) bu Sözleşmeye riayet etmek; (iii) herhangi bir İçeriğin üçüncü tarafların haklarını ihlal ettiğine dair iddialara yanıt vermek; (iv) müşteri hizmetleri taleplerinize yanıt vermek veya (v) Şirketin veya herhangi bir başka kişinin haklarını, malını veya kişisel güvenliğini korumak.

11.8 Kullanıcı bilgi ve Verileri : LEVÂİC Kullanıcı bilgileri aşağıdaki durumlarda paylaşabilir:

11.8.1 Kullanıcı Bilgileri Kullanıcı Olduğunuzda: Adınız, hakkınızda yazdığınız bilgiler  veya kullanıcı adınız gibi kişisel bilgileri içerebilecek incelemeler, sorular, yorumlar, öneriler veya diğer içerikleri LEVÂİC danışmanınızla paylaşabilir. Servis Sağlayıcılar ile Kişisel bilgileri, açıklanan amaçlar doğrultusunda LEVÂİC adına hizmet sağlayan hizmet sağlayıcıları ile paylaşabilir.

11.8.2. Kullanıcı Bilgileri ve Kullanıcı profilleri diğer kullanıcı olan Kullanıcılare kapalıdır. LEVÂİC, Kullanıcınin sadece Adını, doğum yılını, hobilerini, çocuk bilgisini, eğitim bilgisini, sadece iş ünvanı ile iş tipi bilgisini, hobilerini, İlişki Analisti tarafından belirlenen değerlerini Romantik ilişki öneri danışmanlığı adayıyla paylaşabilir.

11.8.3 Araştırmalar İçin: LEVÂİC, Kullanıcılarinden aldığı verileri yalnızca herhangi bir Kullanıcınin kimliğinin tespit edilmesine izin vermeyecek şekilde uygun kontrollerle, kendi araştırma çalışmaları için kullanabilir. Yine LEVÂİC, Kullanıcılarinden aldığı verileri  Kullanıcınin kimliğinin tespit edilmesine izin vermeyecek şekilde uygun kontroller yapılarak   akademik kurumlar, devlet kurumları ve kar amacı gütmeyen kuruluşlar gibi üçüncü taraflarla araştırma amacıyla veya akademik ve politikayla ilgili yayınlar için paylaşabilir.

11.8.4 Çerezler ve Diğer Teknolojilerle: Çerezleri devre dışı bırakmak için tarayıcı ayarlarınızda değişiklikler yapabilir. Kullanıcı çerezlerin bir kısmını veya tamamını devre dışı bırakırsa, hizmet veya hizmetin bir kısmı çalışmayabilir. Daha fazla bilgi için lütfen Çerez Politikası’nı inceleyin.

11.8.5 Kullanıcı, LEVÂİC’in İş Ortaklarıyla Bağlantı Kurduğunda: LEVÂİC Kullanıcı profiline entegre olan üçüncü taraf şirketler; teklifler, ürünler ve hizmetler sağlayabilirler. İş Ortağı ile etkileşime geçmeyi, hizmetleri veya teklifleri için başvuruda bulunmayı, hesabınızı bağlamayı veya senkronize etmeyi seçerseniz, bilgileriniz LEVÂİC’in iş ortaklarıyla paylaşılabilir. Kullanıcı Paylaşılacak bilgilerin kapsamında düzenlemeler yapabilir. Kullanıcınin, Bir Ortağa sağladığı tüm bilgiler, LEVÂİC aracılığıyla veya Kullanıcınin tek başına, onların gizlilik uygulamalarına ve hüküm ve koşullarına tabi olur.

11.8.6 Belirli Ürün Özellikleri İçin: LEVÂİC, belirli ürün özellikleri için üçüncü taraf API hizmetlerini kullanabilir. Kullanıcı, bu özellikleri kullanmayı seçerse, üçüncü tarafın gizlilik politikasına da bağlı olduğunu onaylar ve kabul eder.

11.8.7 Yasal Nedenlerle: LEVÂİC, Kullanıcı bilgilerini yasal nedenlerle, Kullanıcı iznine gerek olmadan ve yasaların izin verdiği şekilde paylaşabilir: Bir mahkeme celbine, mahkeme emrine veya diğer geçerli yasa, düzenleme veya yasal sürece uymak için Kullanıcı bilgileri paylaşımı gerekli olduğunda LEVÂİC şirketi, Kullanıcılari veya diğerlerinin haklarını, mülkiyetini veya güvenliğini korumak için Saldırılara karşı korumak veya korunmak için Hizmet Koşullarını veya diğer sözleşmeleri uygulamak, düzeltmek veya uygulamak için Dolandırıcılığı, siber güvenlik saldırılarını veya yasa dışı faaliyetleri önlemek için Borç tahsilatı için Sizin Rızanızla: Aşağıda belirtilenler dışında, Kullanıcı bilgilerini üçüncü taraflarla yalnızca bize talimat verdiğinizde paylaşırız.

11.8.8 Kişisel bilgilerin üçüncü şahıslara satışı yoktur. Kimliğiniz tespit edilmeyecek şekilde ancak ticari amaçlarla ve gerekliliklerle üçüncü taraflar ile paylaşırız.

12. TOPLULUK KURALLARI

LEVÂİC deneyiminizde aşağıda belirtilen topluluk kurallarına uyacağınızı kabul ve beyan etmelisiniz. Daha ayrıntılı bilgi için lütfen LEVÂİC Davranış Kuralları‘nı inceleyin.

• Kişisel bilgilerinizin paylaşımında seçici olun. Diğer Kullanıcılarin bilgilerini üçüncü taraflarla paylaşmayın. Diğer Kullanıcılarin bilgilerine erişim sağlamaya çalışmayın. Kişileri taklit etmeyin.
• LEVÂİC topluluğu Kullanıcılarine yalan beyanda bulunmayın ve finansal ya da sözel olarak dolandırmayın.
• LEVÂİC topluluğu Kullanıcılarinin alan ve haklarını suistimal ve taciz – fiziksel veya psikolojik- etmeyin.
• Nefret söylemlerinden kaçının. Farklılıklar kaynaklı bölücülükten uzak durun.
• Fiziksel ve psikolojik şiddete başvurmayın. Şiddet içeren söylemlerden kaçının. Dolaylı yoldan şiddet imasında bulunmayın, zorlamayın ve tehdit etmeyin. Fuhuş ve insan ticareti suçlarına karışmayın.
• Çıplaklık ve cinsel öge barındıran içerikler paylaşmayın.
• Kural ihlali sebebiyle LEVÂİC kararınca iptal edilen Kullanıcı ve profilleri tekrar açmaya çalışmayın.
• LEVÂİC hizmetlerini; bölge ve ülke kanunlarına, ve LEVÂİC sözleşmelerine aykırı olarak kullanmayın.
• LEVÂİC hizmetlerini yanlış ve kötü amaçla kullanmayın. Sanal ya da gerçek sunulan LEVÂİC hizmetlerine, topluluğa ve işleyişe zarar vermeyin.

Bu kullanım koşullarından ve hukuk kurallarından herhangi birine aykırı davranış ve tutum gösteren Kullanıcılarin LEVÂİC ile ilişikleri kesilebilir ve gerekli durumlarda hukuki süreçler başlatılacaktır. Yapılan ihlallere göre ödeme iadesi fesh edilebilir.

Kriz anlarında acil durum ekiplerine ve sizin teşhis ettiğiniz ihlaller olması dahilinde derhal bize bildirmenizi rica ederiz.

13. FİKRİ HAKLAR

Fikri mülkiyet ihlali LEVÂİC Topluluk Kurallarınca kabul edilemezdir. Fikri mülkiyet, telif hakkı ve ticari marka ihlali konularındaki şikayet ve bildirimleriniz için lütfen help@levaic.com adresine başvurun. Yalan beyanda bulunanlar ve ihlali gerçekleştirenlerin kullanıcılıkları iptal edilecektir.

Şikayet ve bildiriminizi net ve doğru bir şekilde inceleyebilmemiz için lütfen aşağıdaki bilgileri açık ve anlaşılır şekilde talebinizde belirtin.

• Hakları ihlal edilenin ve onun adına talepte bulunanın iletişim (telefon numaraları, güncel adres ve mail adresi) ve kimlik bilgileri
• İçeriğin kullanılmasına; içerik sahibinin, vekilinin ve yasaların yetki vermediğine iyi niyetle inandığınızın yazılı beyanı
• Hakları ihlal edilen içeriğin tanıtımı
• Orijinal içeriğin haklarını ihlal eden içeriğin tanıtımı ve yayınlandığı yer
• Hakları ihlal edilen adına talepte bulunanın imzası (elektronik ve ıslak imza kabul edilir)
• Verdiğiniz bilgilerin doğru olduğunu, telif hakkı sahibi olduğunuzu ve sahip adına vekil olduğunuzu içeren, yalan beyanın sonuçlarında sorumlu olduğunuzu kabul ettiğiniz yeminli beyanınız

13.1 LEVÂİC Uygulaması içeriğinde sunulan görsel ve yazılı içerik, alan adı, logo, grafik, ses, ikon, tasarım, metin, imge, diğer kodlar, ve teknik veriler, iş metodu ve iş modeli de dahil tüm içeriklerin, marka ve sair fikri ve sınai mülkiyet haklarının sahibi veya lisans sahibi Hizmet Sağlayıcı’dır. Aksi belirtilmedikçe ticari ya da kişisel amaçlarla izinsiz veya kaynak göstermeksizin kullanılamaz.

13.2 LEVÂİC Uygulaması’nda tasarımında ve veri tabanı oluşturulmasında kullanılan yazılımın hakkı Hizmet Sağlayıcı’ya aittir. Söz konusu web sitesi, yazılım ve sair hakların kopyalanması veya kullanılması, kullanılan yazılımların ve teknolojilerin tersine mühendislik işlemlerine tâbi tutulması kesinlikle yasaktır.

14. LEVÂİC HİZMET SORUMLULUKLARI

LEVÂİC, bir hizmet şirketi olarak hizmet verdiği ülke ve bölgelerin yasalarından sorumlu olup yasalara aykırı işlemlerde bulunmaz ve Kullanıcılarinden de bunu bekler. Ülke/Bölge yasalarına aykırı davranan Kullanıcılarin LEVÂİC ile ilişiği kesilir ve ilgili kurum/kuruluş/ekipler bilgilendirilir. LEVÂİC için Kullanıcı geri dönütleri ve beklentileri önem arz etse de LEVÂİC hizmet ilke ve sınırlarını belirleme hakkını kendinde saklı tutar. Yasal sözleşmeler dışında bir sorumluluğu yoktur ve garanti etmez. LEVÂİC tarafından verilen hizmette aksaklıklar yaşanabilir. Aksaklıklar giderilmeyebilir. Edindiğiniz bilgilerde yanlışlıklar olabilir. Bunların olmayacağına dair LEVÂİC tarafından Kullanıcıye bir garanti verilmemektedir.

Kullanıcı, LEVÂİC deneyimi boyunca bildirdiği ve kendisinin yayınlamayı tercih ettiği tüm bilgilerin doğruluğunu beyan eder ve sonuçlarından sorumlu tutulur. Yalnızca reşit bireyleri Kullanıcı olarak kabul eden LEVÂİC, güvenlik önlemleri almakta olmasına rağmen hiçbir Kullanıcısinden sorumlu değildir ve diğer bireyler ile etkileşiminizde olumsuz bir deneyim yaşamayacağınızı garanti etmez.

LEVÂİC, Hizmetle ilgili öneriler, yorumlar, girdiler veya diğer geri bildirimleri sağlayabilir veya Kullanıcıden talep edebilir. Kullanıcı, LEVÂİC’e herhangi bir geri bildirim sağlarsa, LEVÂİC’e onu kullanma, çoğaltma, kamuya açık olarak görüntüleme, dağıtma, değiştirme için daimi, geri alınamaz, telifsiz, dünya çapında, alt lisans verilebilir ve devredilebilir bir lisans vermiş olur. Kullanıcı, kendisinin sağlamayı seçtiği herhangi bir geri bildirimi tamamen gönüllü olarak verir. Kullanıcı, geri bildirimi için herhangi bir tazminat almayacağını ve LEVÂİC’in Kullanıcınin sağladığı herhangi bir geri bildirimi, LEVÂİC hizmetlerini iyileştirmek veya yeni özellikler ve hizmetler geliştirmek için kullanabileceğini kabul eder.

15. ULAŞILABİLİR ÜÇÜNCÜ TARAF HİZMETLERİ

Üçüncü taraflar tarafından sunulan reklam ve promosyonlar LEVÂİC bünyesinde değildir. Bu sebeple de kullanım süreç ve sonuçlarından LEVÂİC sorumlu değildir. O hizmetleri kullanmak Kullanıcınin kendi tercihidir. Kullanıcı, Kullanıcınin kullanması dahilinde LEVÂİC’in değil o hizmeti sağlayan kurumun sözleşme ve şartlarına tabi olur.

16. SORUMLULUĞUN SINIRLANDIRILMASI

• LEVÂİC hizmetlerine internet, telefon, mail ya da herhangi bir yoldan erişim sağlayabilmeniz, sağlayamamanız, alabileceğiniz hizmetleri kulanmanız veya kullanmamanız durumlarında
• LEVÂİC çatısı altında diğer Kullanıcılar, üçüncü taraflar ya da hizmetler ile etkileşimlerinizde, onların davranış ve tutumları, onlarla anlaşmalarınız ve onlarla yaşadığınız deneyimlerde
• Sizin verilerinize illegal erişim sağlanması, verilerinize telif ihlalinde bulunulması ve verilerinize erişim sonucu değişiklikler yapılması durumlarında;

LEVÂİC ekibi ve şirketi sizin para, kâr, veri, kullanım, manevi ve diğer kayıp ve hasarlarınızdan sorumlu değildir. Bu kayıp ve hasarları yaşamamanız için önlemler alınır fakat yaşamayacağınız garanti edilmez.

LEVÂİC’İN HİZMETLE İLGİLİ TALEPLER İÇİN SİZE KARŞI TOPLAM SORUMLULUĞU, BİR HESABA SAHİP OLDUĞUNUZ SÜRECE, EĞER ÖDEME YAPTIYSANIZ, TARAFINIZCA HİZMET İÇİN ÖDENEN TUTARI VE 100 USD DOLAR’I HİÇBİR ZAMAN AŞMAYACAKTIR.

Kullanıcınin, Yasalarının altında olduğu bölge ve ülkeye bağlı olarak zararlar kanunları değişiklik göstermektedir. LEVÂİC, bulunduğu bölge ve ülkenin yasa ve kanunlarına uymak zorundadır. Yasalarca verilen bir karar LEVÂİC’de de kabul edilir. Bu sebeple işbu sözleşmede bölge/ülkesel farklılıklar istisnai sayılan kabullerdir.

17. GİZLİLİK

• 17.1 Kullanıcılar, LEVÂİC Uygulaması çerçevesinde sağladıkları tüm bilgilerin gizli bilgi olduğu (“Gizli Bilgi”) hususunda mutabıktırlar. Hizmet Sağlayıcı, Kullanıcılar’in profil ve görüşme sırasında tercihlerine göre kaydedilen verilerini, Kullanıcılar’in izin verdiği kapsamda Danışmanlar dışında herhangi bir şekilde üçüncü kişilere açıklamamayı ve söz konusu Gizli Bilgilerin gizliliğini temin etmek üzere gerekli tüm önlemleri almayı beyan ve kabul etmektedir.

17.2 Bu Sözleşme çerçevesinde, Kullanıcılar tarafından açıklanan bilgilerin; (a) Gizli Bilgi’nin şu anda veya daha sonra bilgiyi edinen tarafın ihmal ve kusuru dışında kamuoyu bilgisi haline gelmesi, (b) Gizli Bilgi’nin açıklayan tarafın açıklamayı yapmasından önce bilgiyi edinen tarafından bilinmesi (c) Gizli Bilgi’lerin bilgiyi edinen tarafın, hukuken Gizli Bilgi’yi açıklama hakkına sahip olan üçüncü kişi tarafından açıklanması veya verilmesi (d) Gizli Bilgi’nin, yürürlükteki kanuni düzenlemeler veya verilmiş olan bir mahkeme kararı, idari emir gereğince açıklanması veya verilmesi durumlarında bu Sözleşme’de yer alan gizlilik yükümlülüğüne ilişkin hükümler uygulanmayacaktır.

17.3 İşbu 16. maddede düzenlenen gizlilik yükümlülüğü, Sözleşme’nin herhangi bir sebeple sona ermesi halinde de geçerliliğini sürdürecektir.

18. UYGULANACAK HUKUK

• İşbu Sözleşme Delaware Eyaleti Kanunlarına tabidir. Taraflar, işbu Sözleşme’nin uygulanmasından doğacak her türlü uyuşmazlıkları önce kendi aralarında sulhen halletmeye gayret ederler. Sulhen halledilemeyen uyuşmazlıkların çözümü için Delaware Eyaleti Kanunları ve mahkemeleri’nin münhasıran yetkili olduğunu kabul ve beyan ederler.

19. FESİH

LEVÂİC Hizmet Sağlayıcı olarak, Kullanıcılar’in işbu Sözleşmeyi ihlal ettiğinin tespit edilmesi halinde ya da durumun gerektirdiği ölçüde hiçbir sebep göstermek zorunda olmaksızın uygulamayı kullanmaktan ve erişimden men edebilir, profilleri askıya alabilir, geçici olarak kullanımı durdurabilir.

20. DEVİR

Kullanıcılar, işbu Sözleşme tahtında hiçbir hakkını veya yükümlülüğünü devredemez.

21.ŞİRKETE TAZMİNATINIZ

LEVÂİC, Kullanıcılarin LEVÂİC hizmetlerine internet, telefon, mail ya da herhangi bir yoldan erişim sağlayabilmesi ve alabileceği hizmetleri kullanmaları durumlarında, LEVÂİC kural ve sözleşmelerine aykırı davranmaları, ihlalde bulunmaları durumlarında, ve bu durumlar sonucunda gerçekleşebilecek beyan, itiraz, talep, borç, kayıp, zarar, masraf ve ödemelerde; Kullanıcılar, LEVÂİC ekip ve şirketini gözetmeyi ve zararları karşılamayı kabul eder.

22. DİĞER.

İşbu Sözleşme; Güvenlik ve Politikası, Site Güvenliği, Çerez Politikası, Güvenlik İpuçları ve Davranış Kuralları,LEVÂİC içi satın alımlar, ekstra ürün, eşya, içerik, özellik ve hizmetleri kapsayan sözleşmelerin tümünün sözleşmesidir. Sözleşmenin her bir maddesi hem bağımsız hem bağlayıcıdır. Herhangi bir/birkaç maddenin ihlal veya iptali durumunda diğer maddeler geçerliliğini sürdürür. İstisnai durumların oluşması ve LEVÂİC şirketinin herhangi bir madde/maddeleri uygulamaması, o maddenin hüküm ve haklarında cayma anlamına gelmez.

23. YÜRÜRLÜK

Bu Sözleşme uygulama kullanılmaya devam edildiği ve Hizmet Sağlayıcı tarafından yeni bir sözleşme sunulmadığı sürece yürürlükte kalacaktır. Yukarıda yazılı olan ilkeleri onaylamanız durumunda LEVÂİC uygulamasından aldığınız tüm hizmetleri ulusal tedbirler süresince sürdürmeyi ve işbu metinde yer alan bütün bilgileri/sorumlulukları kabul etmiş ve onaylamış sayılırsınız.

LEVÂİC USER AGREEMENT

1. ACCEPTANCE OF THE AGREEMENT AND PARTIES

Before performing any activities through our mobile application or website belonging to the company “LEVÂİC,” you hereby declare that you accept the terms of use stated herein, together with the preliminary documents and special conditions including the Security and Policy, Security and Complaint Notification, Cookie Policy, Safety Tips, and Community Rules.

LEVÂİC reserves the right to make changes to the terms of use due to nationwide changes, modifications in services, revisions, feedback received, identification of additional requirements, or changes in company policies. In the event that changes are made, our Users who have previously accepted the Agreement shall be informed about such changes.

The most current version of this Agreement will be published under the contracts or profile section, and also at www.levaic.com and within the LEVÂİC application, and you are required to regularly check the most current version. The most current version shall be the valid version. If the changes constitute material changes affecting your rights or obligations, (unless there is a legal obstacle under applicable law) we will notify you at least 30 days prior to such changes through the Service, including notification or email and other appropriate means. If you continue to use the Service after the changes become effective, you shall be deemed to have accepted the amended Agreement.

This User Agreement (“Agreement”) is entered into between Levintelligence, INC., residing at 8 the Green STE D, Dover, Delaware, County of Kent, 19901 United States of America (“Service Provider”), and the natural or legal persons (“Users”) who wish to benefit from the consultancy services offered through the website www.LEVÂİC.com and the “LEVÂİC” application (“LEVÂİC Application”) made available across various platforms, and who become Users of the LEVÂİC Application within this scope, in order to regulate the terms and conditions of use of the LEVÂİC Application.

2. SUBJECT OF THE AGREEMENT

This Agreement regulates the terms and conditions under which the User may benefit, in line with the selection made from the consultancy service packages specified in the LEVÂİC Application, from consultancy services to be received through video, audio, and written communication channels via experts or clinical psychologists, family and couples therapists, and expert executive coaches (“Consultant”) in the areas needed; as well as personal development content (GROWTH) and other networking and experience-oriented services (“Services”), and also regulates the rights and obligations of the parties regarding the fee to be paid in return. LEVÂİC provides consultancy-based services to its users in the fields of personal development, well-being, and relationship competency development.

This data transfer is carried out solely within the scope of explicit consent and limited to the purpose of service, in accordance with Law No. 6698 on the Protection of Personal Data (KVKK), EU GDPR, and the U.S. Delaware Privacy Law. The Service Provider offers, through the LEVÂİC Application, a digital consultancy platform through which users may receive the above-mentioned content and services.

3. TERMS OF USE AND OBLIGATIONS OF THE SERVICE PROVIDER

3.1 Creating a profile on the LEVÂİC Application is free of charge.

3.2 Users accept and undertake that all information declared during profile creation, including name, address, telephone, e-mail, and all other information, is current, accurate, and complete, and the Service Provider is not obligated to verify the accuracy or currency of such information.

3.3 Users of the application confirm that they approve this Agreement when creating a profile through the application and accept and undertake to comply with this Agreement from the moment they begin benefiting from the application.

3.4 The Service Provider has the right to unilaterally amend or modify this Agreement in order to ensure the continuity of the services provided through the application or to comply with legislation. The Agreement amended or modified in this manner shall become effective as of the date of its publication.

3.5 The Service Provider may, without providing any reason, refuse to accept individuals who wish to become Users of the LEVÂİC Application, remove Users, prohibit the use of and access to the application, suspend profiles, or temporarily discontinue usage. Likewise, Users have the right to completely leave the system at any time.

3.6 The Service Provider has no responsibility regarding any information, advice, or matters suggested by Users and Consultants through the LEVÂİC Application, or regarding messages transmitted during their meetings, and under no circumstances shall the Service Provider be liable for any damages or losses arising therefrom.

3.7 The profile information of Users who receive consultancy services through the LEVÂİC Application, as well as the information recorded by Consultants during sessions, may be stored for the next session or deleted in accordance with the Users’ preferences.

3.8 Users’ profile information and the information recorded by Consultants during meetings shall be stored by the Service Provider and the Consultant within the framework of confidentiality principles until the User terminates their membership.

3.9 The Service Provider works to ensure uninterrupted access for Users of the LEVÂİC Application. However, pursuant to legislation or for various other reasons, Users’ access to the application may be suspended, restricted, or terminated temporarily or permanently.

3.10 Consultancy Sessions

In cases where face-to-face meetings are restricted or not appropriate, online psychological counseling/therapy/coaching has been used worldwide for many years as a practice whose effectiveness has been proven in terms of psychological health. The success of the work depends on the client’s cooperation with the consultant and open communication.

3.10.1 Psychological Counseling, Therapy and Psychoeducation Services

LEVÂİC provides Counseling and Therapy services via the internet, which is considered a “non-traditional psychotherapy environment,” within the framework of the Ethical Regulations of the Turkish Psychologists Association and in 50-minute sessions. Counseling and Therapy sessions constitute a series of consecutive meetings. The LEVÂİC team providing this service consists of mental health professionals, including clinicians and/or family and couples therapists, psychologists and sociologists specialized in relationships, who have completed the necessary expertise and competencies.

Counseling and Psychoeducation sessions include reflection, learning pathways, and research, may include life application suggestions when necessary, and the consultant may provide future guidance and recommendations appropriate to the individual’s well-being. The client’s past experiences are addressed. Sessions may be therapeutic. Compliance with or non-compliance with this session structure is at the User’s own discretion. LEVÂİC accepts no responsibility.

This service of LEVÂİC primarily aims to ignite the User’s inner heart fire and at the same time to support the User in creating safe and sustainable relationships during both challenging and easy times.

3.10.2 Coaching Sessions:

LEVÂİC provides Coaching services to Users within the framework of the internationally approved (ICF) International Coach Federation Ethical Code and in 50-minute sessions. Coaching conducted online and face-to-face is one of the services offered at LEVÂİC under the name of education and consultancy. Coaching and education services, which are not advice or therapy, may be directed toward the User’s professional life goals, work, mission, vision, objectives, or personal goals in their general life. The work carried out during the service process includes, but is not limited to, clarifying mission, vision, and values; identifying strengths; generating new ideas; creating a roadmap; determining action plans; defining operational mechanisms; asking illuminating questions; making empowering requests; and encouraging the User to take action. Additionally, one of the objectives of these services is to provide the necessary awareness-enhancing information in areas where the User needs it and to enable the User to create a roadmap for themselves.

Coaching sessions constitute a series of consecutive meetings. A coaching session does not include advice; it explores together the topics the individual wishes to research, examines the solutions that the individual will create regarding the subject, supports and follows them. While doing all this, it provides reflection and seeks new learning paths by mutual agreement with the User. Compliance with or non-compliance with this session structure is at the User’s own discretion. LEVÂİC accepts no responsibility.

This service of LEVÂİC primarily aims to ignite the User’s inner heart fire toward reaching their ideal self and at the same time to accompany the User in this journey, in their perspective on life and in their learning.

• Shared Responsibility:

The usefulness of all Counseling, Coaching, Psychoeducation, and Therapy sessions provided by LEVÂİC falls within the scope of shared responsibility. At this point, it is important for the User to be responsible: the User must be honest, must state what they want, and must inform their Consultant about what works and what does not work in the counseling relationship. In coaching sessions, unlike other counseling sessions, the User must determine the agenda of the meeting, and the Coach undertakes to be courageous, candid, and unconditionally constructive in order to ensure maximum benefit from the sessions.

• The Difficulty of the Session:

The dynamics of clinical and therapy sessions are much deeper and function differently compared to other counseling sessions. The therapist may apply techniques accepted within ethical values and demonstrate competencies in order to enrich the User’s insight. The dynamics of coaching sessions differ from other sessions. Depending on the User’s process, the Coach may make direct requests or challenge the User. The User may feel uncomfortable or bad. The purpose of direct request/challenge is to help the User achieve their goals. The User may accept, make a counter-offer, or reject these requests/challenges. If the User chooses to reject when necessary, the User undertakes to select together with the Coach a method that is beneficial for them.

3.10.5 Postponement and Cancellation of Sessions

The User may postpone or cancel the consultancy session they have purchased or obtained via coupon up to 24 hours prior to the scheduled time. Changes are not accepted for sessions with less than 24 hours remaining. In special circumstances, arrangements may be made with the consultant with whom the User will conduct the session; this is at the consultant’s initiative, and no coercion is applied.

If you are unable to attend the session, you have the right to request a change of the session date up to at least 24 hours before the session time. You are required to pay for sessions that are not postponed at least 24 hours in advance.

3.10.6 Session Rules and Informed Consent Information

• Privacy:

1. Information shared during the session shall remain between the User and the consultant unless the User gives permission, except for issues that may arise from service providers. However, in cases such as abuse, suicide risk, or harm to yourself or your relatives, the User’s relevant information may be shared without your permission, in accordance with professional ethical principles and laws, and only with authorized authorities and courts when an obligation arises.
2. Data considered scientifically valuable may be used for academic purposes, provided that identity information is kept confidential.
3. The consultant undertakes not to share any data related to communication established with the User, in a manner that violates confidentiality, with third persons, institutions, or online-offline media tools. Participation in online therapy shall be understood as acceptance of the condition not to record any part of the above conditions and sessions, and not to allow others to listen to the session (via phone or any other device or tool) without prior agreement.
4. If the informed consent form, which undertakes that sessions will protect User privacy within the framework of personal data protection law, is approved, as a User you confirm that you will ensure the consultant’s confidentiality. Unless agreed in advance, the User undertakes that neither the User nor any person other than the User will listen to the session by any means, will not record the sessions by any means, and will protect them within the scope of personal data protection law.
5. Within the scope of Law No. 6698 on the Protection of Personal Data, the section titled “Application Form Questions” completed by the User in the Application Form is protected by LEVÂİC as it falls within the scope of special category data.

• Session Duration and Communication:

1. Counseling sessions last 50 minutes. The session duration may exceed 50 minutes or be shorter if deemed necessary by both parties. The consultant may arrive late to the session due to reasons beyond their control; in such a case, they complete the 50 minutes by extending your session time. If the User arrives late to the session, the consultant does not extend the session time, and the session ends at its normal time.
2. At the consultant’s own initiative and when deemed necessary, a free 15-minute introductory meeting may be conducted; the brevity or length of this duration is at the consultant’s initiative.
3. The consultant may, at their own initiative and when deemed necessary, also provide sessions via messaging on the platform.
4. During the session, the User must ensure that they will not be disturbed, that they have privacy in the room they are in, and that the door to the room is closed.
5. The User must not engage in phone calls during the session.
6. Communication between the consultant and the User is expected to be within the framework of respect. If one party exceeds respect, the other party has the right to terminate the session.
7. The User must not attend sessions in situations that would prevent them from being conscious (such as under the influence of alcohol, substances, or medication). If it is understood during the session that the User is under the influence of substances or alcohol that may prevent consciousness, the consultant may terminate the session. In such a case, all responsibility belongs to the User. No refund is made, and no compensation session is provided.

• Shared Responsibility: The usefulness of Coaching and Therapy sessions falls within the scope of shared responsibility. At this point, it is important for the client to be responsible: the client must be honest, must clearly state what they want, and must inform their consultant about what works and what does not work in the counseling relationship.

• Consultant Subjectivity:

1. The consultant may have specific session criteria within ethical rules (such as no eating, no drinking, no tobacco use, etc.). They may inform the User of these before or during the session. The User is expected to be sensitive to the rules deemed necessary by the consultant. If there is a question regarding the stated rules, the User must request an answer from the consultant.
2. Session planning varies according to each consultant and User. Generally, the session plan should be created together by the consultant and the User in the first session. Changes may occur in planning according to session developments. The User is expected to comply with the session planning created with the Consultant.

• The consultant may recommend LEVÂİC GROWTH content, Blog services, workshop/seminar services to be held at Levâic Talks, and Levâic Follow-up Coaching to the User;

• The duration of tests conducted in LEVÂİC GROWTH varies depending on the nature of the test. The User must be clearly informed on this matter.

• If deemed necessary, our expert may recommend that you consult a psychiatrist to evaluate your situation.

• You may ask your consultant questions regarding your psychological counseling process, your own life experiences, or your consultant’s education and qualifications.

3.11 Relationship Competency Analysis Session Service (RCA):

3.11.1 LEVÂİC conducts a “Relationship Competency Analysis” session with matching analysts composed of expert family and couples therapists, psychologists, and coaches in their respective fields, in order to get to know the User and the User’s relationship needs and competencies. It is conducted separately from Counseling, Coaching, or Therapy sessions and in accordance with the (ICF) International Coach Federation Ethical Code. Sessions last 50 and/or between 50 and 120 minutes.

3.11.2 Every user may benefit from the Relationship Competency Analysis Service of the LEVÂİC application.

3.11.3 At the end of the Relationship Competency Analysis Service of the LEVÂİC application, a report is provided. In line with this report, it serves as guidance for Users to benefit from Psychological Counseling, Psychoeducation and Therapy Services, Coaching Session Services, and GROWTH Program Services suitable for them.

3.12 GROWTH Program Service:

LEVÂİC provides GROWTH Service to all subscribed Users. The GROWTH Center includes recorded trainings in order to provide holistic services to Users in the light of psychological science. Below you may find clauses that may be added to the user agreement for the GROWTH e-learning program. These clauses help clearly define the nature of the program, its usage, and the responsibilities of users:

Access to Educational Materials: Users enrolled in the GROWTH program have the right to access the educational materials provided by the program. These materials may only be used for personal and educational purposes.

User License: Registered users may download, view, and print GROWTH materials for personal use. However, reproduction, distribution, or commercial use of these materials in any way is prohibited.

All content, materials, and resources presented in the GROWTH program are protected by copyright and intellectual property laws. The copyright owner of these contents is LEVÂİC and/or its licensors.

The User undertakes to use the content of the GROWTH program only in accordance with legal and ethical rules. Users are responsible for any illegal, immoral, or copyright-infringing use.

The protection of personal data provided while enrolling in the GROWTH program is subject to LEVÂİC’s privacy policy. Users are responsible for the accuracy of the information they provide during registration.

LEVÂİC reserves the right to change GROWTH content and terms of use without prior notice. Users must regularly review the terms of use to stay informed of such changes.

Users agree to use GROWTH and its content solely for educational, developmental, and learning purposes. Any commercial use is prohibited.

LEVÂİC cannot be held responsible for any direct or indirect damages, losses, or expenses arising from the use of the GROWTH program. Users accept the risks that may arise as a result of using the program.

3.13 Levâic Talks Event and Seminar Service:

Levâic not only provides individual consultancy services; it also aims to support users’ relational awareness through psychoeducation seminars, workshops, panels, and community gatherings conducted both online and offline under the Levâic Talks umbrella. These events are prepared by expert facilitators and carried out within the framework of Levâic’s ethical principles. Users may participate in events by registering via the mobile application or website. The content shared during the event is evaluated only within internal service processes, and user privacy and security are primarily protected.

3.14 Levâic Follow-up Coaching Service:

The Levâic Follow-up Coaching service is structured to support users in implementing the gains they have acquired during the consultancy process into their lives, to track their development through a digital roadmap, and to ensure goal-oriented progress. This service provides an individualized follow-up plan, periodic coach guidance, goal reminders, and development recommendations. Communication between the coach and the user may be conducted through online meetings or by telephone. Follow-up Coaching does not replace psychotherapy; however, it is a holistic support system that strengthens the individual’s ability to know themselves and to act in a goal-oriented manner.

3.15

By registering to use the GROWTH, Levâic Talks Event and Seminar Service, Follow-up Coaching, Online Consultancy, and Relationship Competency Measurement Services, you accept and guarantee that you have not been convicted of any crime and that no complaint involving sexual harassment has been filed against you. LEVÂİC reserves the right to investigate the criminal history of its users and to conduct further background inquiries; it may access public records at any time to check the background of its users. Individuals convicted of hate crimes, rape, domestic violence, harassment, fraud, or other crimes are not suitable persons to use this application and the services it offers. If it is determined that a user has been convicted of any crime despite being a User, the User’s membership shall be terminated immediately without refund, and it shall be considered that the application administrators were intentionally misled, and a criminal complaint shall be filed with the relevant authorities for legal action.

3.16

All online and offline interactions you establish with other users through LEVÂİC consultancy combination services are at your own risk and responsibility. You accept that you must personally take all necessary precautions to ensure your personal safety in your relations with individuals you communicate with and meet through the matching service.

3.17

Users are prohibited from requesting the contact information of other Users they meet at Levâic Talks events or from following them on social media or other platforms; under no circumstances may you disturb them, including coercion, harassment, or threats.

3.18

Page content is arranged for the purpose of informing users and may be updated without notice when deemed necessary.

3.19

The User accepts that when using this application for a specific purpose, no guarantee is provided by us, by any third party, by the employee or owner of a recommended meeting location, or by a matched User that they will not be exposed to any negative experience.

4. PROFILE AND INTEGRATIONS

In order to benefit from LEVÂİC services, Users must first complete their profile information or application form. Users must ensure that the information stated in their profile or application form is accurate and up to date. LEVÂİC will obtain the User’s information from the information specified in the forms completed by the User.

The information to be shared in the User profile is specified in the profile information or application form. The User who owns the profile is responsible for any information they choose to share beyond that information. The User must ensure that they protect their Profile with a strong password. LEVÂİC is not responsible for losses arising from stolen passwords and does not have access to the User’s current password. For security reasons, LEVÂİC may only provide instructions on how the User can reset their password. The User may not request access to an account that does not belong to them or request information related to such an account. If the User believes that someone else has gained access to their profile, they must notify LEVÂİC. For more information about the data collected from the User by LEVÂİC and how it is used, the User may review the Security and Policy.

LEVÂİC is a digital consultancy platform providing services in the field of personal development.

5. CHANGES IN SERVICES

LEVÂİC reserves the right to make changes to the terms of use due to nationwide changes, modifications in services, revisions, feedback received, identification of additional requirements, or changes in company policies. The scope of these changes includes the addition of new features and services, additions to and removals from the features of existing services, and the removal of certain existing services and features. Users of LEVÂİC shall be informed about such changes. In the event of critical and material changes, updated contractual terms shall be presented to users, and agreements shall be renewed with users who accept them. The data that may be collected within the scope of existing modules is limited to emotions and thoughts conveyed during participation, trainer or coach notes, development scores, content consumption records, and actions taken in line with coach recommendations. This data is used solely for the personalized planning of the service and for development tracking.

Users who wish to terminate their membership due to changes made or for any other reason have this right. When the User terminates their membership, they approve and accept that LEVÂİC may permanently delete their account and all data that may be associated with them. Depending on the package to which the User is subscribed and the services included, payment and refund conditions may vary upon termination of membership. Before becoming a User of a selected package, LEVÂİC clearly presents all features, conditions, cancellation, and refund terms of that package. Users carefully read and retain the documents and information presented during the subscription stage to packages. For other questions regarding the matter, Users may visit the “Frequently Asked Questions” and “LEVÂİC Code of Conduct” pages or contact LEVÂİC at help@LEVÂİC.com.

If the User terminates their membership, they must read and confirm acceptance of the Post-Cancellation or Post-Freezing Conditions of Membership within the framework of confidentiality and security measures. These conditions are intended to protect Users and other users.

6. PERSONAL SAFETY

LEVÂİC is a company that progresses with the mission of spreading safe and sustainable relationships throughout society and strives to take steps in line with this mission at every stage, from user selection to the services provided. Our effort to minimize situations in which Users may be harmed unfortunately does not provide a 100% guarantee, and LEVÂİC cannot be the guarantor or reference for any User. In the LEVÂİC community consisting of adults, each individual is responsible for themselves. Users accept that they have carefully read the “Safety Tips” and the “LEVÂİC Code of Conduct” prepared by LEVÂİC to increase the safety of Users; and especially that when Users decide to meet face-to-face or in their online communications, they will carefully select the information they share and the decisions they make.

7. YOUR LICENSE RIGHTS AND LOSS OF RIGHTS

If you are accepted as a LEVÂİC User and become part of the LEVÂİC community, you obtain the usage license provided by LEVÂİC and benefit from the license rights. However, behavior contrary to LEVÂİC rules and conditions may result in the cancellation of your license. The LEVÂİC Code of Conduct and the rules listed below are prerequisites for benefiting from the LEVÂİC license.

• Do not use any product, service, or content provided to you via the LEVÂİC mobile application, website, email, or message, and whose copyrights belong to LEVÂİC, in violation of intellectual property law. Do not copy, reproduce, share, or commit plagiarism unless you have obtained written permission from LEVÂİC. Do not make any manipulation or alteration within the system.

• Do not attempt to gain unauthorized access to data collected by LEVÂİC. Do not access, copy, or share technical data and the programming interface. Do not attempt any manual or automated data scraping methods.

• Do not use any product, service, or content prepared by LEVÂİC for commercial purposes without company approval.

• Do not use designs, content, and products specific to LEVÂİC without permission. Do not present or use these designs, content, and products as referential for any person, institution, or site not belonging to LEVÂİC.

• Do not present LEVÂİC as a reference for your own ideas and opinions. Unless you have our written approval, do not declare that you have received LEVÂİC approval.

• Do not share with third-party applications, or use in other applications, the services and information provided to you by LEVÂİC, or information you have obtained about other users through the company.

• Do not engage in actions—manual or automated—that disrupt or damage LEVÂİC services and features. Do not use malicious software (malware) within LEVÂİC services.

• Do not perform vulnerability scanning on any service belonging to LEVÂİC. Do not attempt to obtain information about the identification, classification, and prioritization of security vulnerabilities. Do not attempt actions that would pose a threat to system security.

• Comply with every rule of the Agreement. Please report those who do not comply to us. If this Agreement is not complied with, the Agreement shall be terminated and legal action shall be initiated.

8. PRICING, PAYMENT, CANCELLATION, AND POSTPONEMENT CONDITIONS

If you believe there has been an error after your payments have been received, you may contact us for information or submit a direct objection. You may submit your request for information or objection via LEVÂİC, through the intermediary used for payment, or through the bank where the payment was made.

You may make changes—such as card information or instruction duration—to your automatic payment instruction at your own bank and may cancel it at any time. If you cancel your automatic payment instruction and payment is not made despite continuing to receive services due to insufficient balance or non-payment, you accept that these constitute official debts belonging to you and that legal processes will be initiated if payment cannot be collected.

Changes made by you will also be reflected in billing. Your information will be updated and may cause changes in invoice issuance dates. If you make your payment via credit or debit card, updates and renewals such as expiration dates on your card are notified to us by your card provider and your information is updated.

Many factors may be effective in determining payment dates. The payment date will be determined according to your agreements with the relevant financial institution, bank, or other card provider.

Users have the right to postpone their subscription packages, reschedule their consultancy session appointments, or make changes to the purchased session package. You must follow the procedure for postponement or modification of packages and consultancy sessions. If these steps are not followed, your change or cancellation request will not have been received by us and the service will continue to be provided to you. Deleting the Website/Application from your phone will not fulfill this request. If membership cancellation or modification is successfully completed, you may continue to benefit from services for the agreed period at the beginning of the term. In the new period, your subscription to the package will not be renewed.

If, without completing this process, you withdraw your payment by any means and cancel the payment, your membership will be canceled. In case of withdrawal and cancellation, the invoice provided to you by LEVÂİC during payment will be amended and corrected.

8.1 Pricing Conditions

The fee to be paid in return for the Services specified in this Agreement is indicated separately for each consultancy session and as session packages on the profiles of Consultants on the LEVÂİC website/application. Users shall pay the fee specified for the selected package and Consultant via credit card when selecting the package and making a session appointment with the Consultant.

LEVÂİC is a Consultancy Site/Application offering subscriptions based on sessions and user types.

• Basic User: This is the User type to whom only “Consultancy Service” is offered. There is no subscription. When the selected consultancy session appointment is chosen and paid for, it starts automatically. LEVÂİC may change this fee at any time. Pricing may vary in different countries, and actual fees may be converted into your local currency depending on your country of residence. This service only provides access to consultancy services provided by Consultants. Consultancy fees are the session fee determined by the Consultant for 50 minutes. The Relationship Competency Analysis Session fee is fixed at 100 minutes and is processed at a fixed fee.

• LEVÂİC Experience: This is the User type to whom both “Consultancy Service” and “GROWTH Service” are offered. When LEVÂİC Experience is selected, the User benefits from paid and free development studies. For selected paid development studies, the determined fee is paid, and desired consultancy session appointments are selected and paid for. LEVÂİC may change its fee, development study fees, and consultancy session fees at any time. Pricing may vary in different countries, and actual fees may be converted into your local currency depending on your country of residence. This service only provides access to consultancy services provided by Consultants. The duration of development studies varies according to content. Consultancy fees are the session fee determined by the Consultant for 50–100 minutes.

8.2 Payment Conditions

The LEVÂİC application may apply different pricing for personalized services required according to Users. Payment will be collected from your credit card with purchase approval via the STRIPE / Payoneer payment system. There is no automatic renewal or storage of credit card information in LEVÂİC. Users purchase consultancy packages once; subscription packages are renewed monthly, quarterly, semi-annually, and annually. If a user decides NOT to subscribe at the end of the trial or automatic renewal period, the user will be downgraded to Basic User status.

8.3 Cancellation and Postponement Conditions

Refunds cannot be made under any circumstances in LEVÂİC services. Before purchasing these services, the User is informed that there is no right of refund, and if the User approves this Agreement, the purchase request is approved. This is final for purchases for which the User has given approval. If the User wishes to unsubscribe, no fee will be refunded.

Consultancy services sold on the LEVÂİC Site/Application are conducted through an appointment system. Appointment changes or package cancellation may be made free of charge up to 24 hours in advance. Users may complete these processes via change notification sent by email during purchase. Appointment changes may be made to another available time of the Consultant.

Content purchases on the LEVÂİC Site/Application are made through the relevant modules and profile section.

The LEVÂİC platform provides emotional intelligence development, relationship competency analysis, and personal transformation-focused content and consultancy services.

Every user who accepts this document shall be deemed to have accepted the following conditions:

• When a consultancy appointment is purchased, no refund is made; you may postpone your appointment with the same consultant to another suitable date of the same consultant up to 24 hours in advance.
• You cannot count a session purchased from one consultant in place of a session with another consultant; the system is not designed for this.

9. RIGHTS AND OBLIGATIONS OF THE CONSULTANT

9.1 By completing the private consultant profile information in the LEVÂİC Application, the Consultant accepts and undertakes that the information provided is accurate and agrees to provide consultancy services to Users within the LEVÂİC Application.

9.2 The Consultant shall provide services to Users through the LEVÂİC Application in accordance with the relevant legislative provisions, and within the scope of the sessions conducted with Users, if the Consultant determines that coaching sessions are not sufficient for the User, the Consultant shall refer the User to a therapist who is a consultant within LEVÂİC. If, within the scope of the sessions conducted with Users, the Consultant determines that psychotherapy is not sufficient for the User, the Consultant shall refer the User to a psychiatrist. The LEVÂİC Application provides consultancy services for those who do not have the opportunity to receive face-to-face therapy and coaching due to time, location, or economic reasons and is not a medical treatment service intended for diagnosis or therapeutic purposes. The Consultant has the right to terminate the service if it is determined that the session within the scope of the LEVÂİC Application is not appropriate and/or does not provide benefit.

9.3 During the use of the LEVÂİC Application, the legal responsibility for all information, documents, services, texts, expressions, files, images, etc. added by the Consultant belongs to the Consultant.

9.4 Online Consultancy, Relationship Competency and various assessment sessions, Growth development videos, Levâic Talks, and Follow-up Coaching services do not replace therapeutic intervention. These contents are for informational and developmental purposes and do not aim to provide medical or psychological diagnosis or treatment.

10. RIGHTS AND OBLIGATIONS OF USERS

LEVÂİC carefully ensures the regulation and supervision of what is written in the community rules. However, in our community consisting of adults, each individual is responsible for themselves. LEVÂİC is not a reference for any User. Users who do not comply with LEVÂİC rules are responsible for the consequences. If you detect behavior, attitude, profile, or content that does not comply with LEVÂİC rules, please notify LEVÂİC authorities.

10.1 Users accept and undertake that they are over 18 years of age and that all information declared during profile creation, including name, address, telephone, e-mail, and all other information, is current, accurate, and complete. In the event of detection of contradictory situations regarding such information or where the information is incomplete and/or its accuracy cannot be verified, Consultants have the right to terminate the session and prohibit Users from accessing the LEVÂİC Application.

10.2Users may not share their account login information, such as username and password, with third parties, nor may they allow third parties to access their accounts. Users are solely and entirely responsible for the information and content they distribute, publish, or make accessible through matching, networking, and consultancy services, as well as for their interactions and sharing with other registered Users.

10.3 Users have the right to select or change any Consultant registered in the LEVÂİC Application. However, the Service Provider does not guarantee the quality or suitability of the services provided by Consultants and cannot be held responsible in this regard.

10.4 Users accept, declare, and undertake that the Service Provider is not obliged or responsible to control the content provided by Consultants or to investigate whether there is any unlawful activity or situation regarding such content or the goods and services subject to such content. Users accept, declare, and undertake that all responsibility arising from the provision of the service belongs to the relevant Consultant.

10.5During the use of the LEVÂİC Application, the legal responsibility for all information, documents, services, texts, expressions, files, images, etc. added by Users belongs to the User themselves.

10.6 Users’ use of any information or material within the LEVÂİC Applications is entirely at their own responsibility; therefore, LEVÂİC accepts no liability. It is the responsibility of the user to ensure that any product, service, or information provided through this application and website meets the user’s specific requirements.

10.7 By accepting this Agreement, Users declare their intention to benefit from the services of the LEVÂİC Application and acknowledge and declare that they are aware of the limits of the services.

11. RIGHTS ACQUIRED BY THE USER IN LEVÂİC

11.1 By creating an account, Users grant LEVÂİC a worldwide, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute information shared, uploaded, displayed, or marked as visible (collectively, “shares”) on the LEVÂİC Service or sent to other Users (collectively, “Content”). LEVÂİC’s license for the User’s Content shall be non-exclusive; however, with respect to derivative works created through use of the Service, LEVÂİC’s license shall be exclusive. For example, LEVÂİC shall have an exclusive license for screenshots of Service screens containing your Content. Additionally, in order for LEVÂİC to prevent the use of your Content outside the Service, Users authorize LEVÂİC to act on behalf of the User regarding infringing uses of Content obtained from within the Service by other Users or third-party service providers. This includes, but is not an obligation, the authority to send notices on behalf of the User in accordance with applicable law, particularly in cases where your Content is taken and used outside the Service by third parties. LEVÂİC’s license to User Content is subject to User rights under applicable laws (for example, laws related to personal data protection for any Content containing User personal information as defined by such laws) and is limited to purposes such as operating, developing, providing, and improving the Service and researching and developing new services. Any Content placed by the User or permitted to be placed by LEVÂİC on the Service may be viewed by other Users and by any person visiting or participating in the Service (such as persons who obtain Content shared by other LEVÂİC Users).

11.2 Upon creation of a LEVÂİC account, the User accepts that all information submitted is accurate and truthful and that the User has the right to publish Content through the Service and grant LEVÂİC the above license.

11.3 The User understands and accepts that LEVÂİC may monitor or review any Content you publish as part of the Service. LEVÂİC may partially or completely delete any Content that, in its sole discretion, violates this Agreement or may harm the reputation of the Service.

11.4 Information from Cookies:

LEVÂİC may use cookies, web beacons, pixels, local shared objects, and similar technologies to provide the experiences you request and to collect information about you. The User may control certain information collected by LEVÂİC from cookies and how it is used. For more information, please review the Cookie Policy.

11.5 Users agree to be respectful and courteous when communicating with LEVÂİC customer service representatives and consultants. If LEVÂİC feels that the User’s behavior toward any LEVÂİC customer service representative or other employees is threatening, disturbing, or aggressive at any time, LEVÂİC reserves the right to immediately terminate the User’s account.

11.6 In consideration for allowing the User to use the Service, the User accepts that LEVÂİC, its affiliates, and third-party partners may place advertisements within the Service. By sending suggestions or feedback to LEVÂİC regarding the LEVÂİC Service, the User accepts that LEVÂİC may use and share such feedback for any purpose without compensation to the User.

11.7 You accept that LEVÂİC may access, preserve, and disclose your account information when required by law, for the fulfillment of the agreement made with the User, or when there is a good faith belief that access, preservation, or disclosure is necessary, such as in the following situations: (i) to comply with legal process; (ii) to enforce this Agreement; (iii) to respond to claims that any Content violates the rights of third parties; (iv) to respond to your customer service requests; or (v) to protect the rights, property, or personal safety of the Company or any other person.

11.8 User Information and Data:

LEVÂİC may share User information in the following situations:

11.8.1 When You Are a User:

LEVÂİC may share reviews, questions, comments, suggestions, or other content that may include personal information such as your name, information written about yourself, or your username with your LEVÂİC consultant. Personal information may be shared with service providers acting on behalf of LEVÂİC for the purposes described.

11.8.2 User information and User profiles are closed to other Users. LEVÂİC may share only the User’s name, year of birth, hobbies, child information, education information, job title and job type information, hobbies, and values determined by the Relationship Analyst with a romantic relationship candidate within the scope of recommendation consultancy.

11.8.3 For Research:

LEVÂİC may use data obtained from Users for its own research studies, with appropriate controls in place to ensure that no User’s identity can be identified. LEVÂİC may also share such data, with appropriate controls to prevent identification of the User, with third parties such as academic institutions, government institutions, and non-profit organizations for research purposes or for academic and policy-related publications.

11.8.4 With Cookies and Other Technologies:

You may disable cookies by making changes in your browser settings. If the User disables some or all cookies, the service or part of the service may not function. For more information, please review the Cookie Policy.

11.8.5 When the User Connects with LEVÂİC Business Partners:

Third-party companies integrated into the LEVÂİC User profile may provide offers, products, and services. If you choose to interact with a Business Partner, apply for their services or offers, link or synchronize your account, your information may be shared with LEVÂİC’s business partners. The User may regulate the scope of information to be shared. All information provided by the User to a Partner, whether through LEVÂİC or independently by the User, is subject to their privacy practices and terms and conditions.

11.8.6 For Certain Product Features:

LEVÂİC may use third-party API services for certain product features. If the User chooses to use these features, the User acknowledges and accepts that they are also subject to the third party’s privacy policy.

11.8.7 For Legal Reasons:

LEVÂİC may share User information for legal reasons without requiring User consent and as permitted by law: when sharing User information is necessary to comply with a subpoena, court order, or other valid law, regulation, or legal process; to enforce, remedy, or apply the Terms of Service or other agreements; to prevent fraud, cybersecurity attacks, or illegal activities; to protect against or defend from attacks; to protect the rights, property, or safety of LEVÂİC, its Users, or others; or for debt collection. With Your Consent: Except as stated above, we share User information with third parties only when you instruct us to do so.

11.8.8

There is no sale of personal information to third parties. Information may be shared with third parties for commercial purposes and necessities in a manner that does not allow your identity to be identified.

12. COMMUNITY RULES

You must accept and declare that you will comply with the community rules stated below during your LEVÂİC experience. For more detailed information, please review the LEVÂİC Code of Conduct.

• Be selective in sharing your personal information. Do not share other Users’ information with third parties. Do not attempt to gain access to other Users’ information. Do not impersonate individuals.

• Do not make false statements to LEVÂİC community Users and do not commit financial or verbal fraud.

• Do not abuse or harass — physically or psychologically — the space and rights of LEVÂİC community Users.

• Avoid hate speech. Refrain from divisiveness arising from differences.

• Do not resort to physical or psychological violence. Avoid violent statements. Do not imply violence indirectly, do not coerce, and do not threaten. Do not engage in prostitution or human trafficking crimes.

• Do not share content containing nudity or sexual elements.

• Do not attempt to reopen User accounts and profiles that have been canceled by LEVÂİC due to rule violations.

• Do not use LEVÂİC services in violation of regional and national laws or LEVÂİC agreements.

• Do not misuse LEVÂİC services for improper or malicious purposes. Do not harm LEVÂİC services, the community, or its operations, whether virtual or physical.

Users who act in violation of any of these terms of use or legal rules may have their relationship with LEVÂİC terminated and legal proceedings may be initiated when necessary. Depending on the violations committed, refund of payments may be terminated.

In times of crisis and in cases of emergencies, including violations you identify, we kindly request that you notify us immediately.

13. INTELLECTUAL PROPERTY RIGHTS

Intellectual property violations are not accepted under LEVÂİC Community Rules. For complaints and notifications regarding intellectual property, copyright, and trademark violations, please contact help@levaic.com. Users who make false statements and those who commit violations will have their memberships canceled.

In order for us to review your complaint and notification clearly and accurately, please include the following information clearly and understandably in your request:

• Contact information (telephone numbers, current address, and email address) and identity information of the rights holder and the person making the request on their behalf

• A written statement that you have a good faith belief that the use of the content is not authorized by the content owner, their representative, or the law

• Identification of the content whose rights are allegedly infringed

• Identification of the content infringing the rights of the original content and the place where it is published

• Signature (electronic or wet signature accepted) of the person making the request on behalf of the rights holder

• A sworn statement that the information you have provided is accurate, that you are the copyright owner or authorized representative, and that you accept responsibility for the consequences of false statements

13.1 All visual and written content presented within the LEVÂİC Application, including domain name, logo, graphics, sound, icons, design, text, images, other codes, and technical data, including business method and business model, and all related trademark and other intellectual and industrial property rights belong to or are licensed by the Service Provider. Unless otherwise stated, they may not be used for commercial or personal purposes without permission or without citing the source.

13.2 The rights to the software used in the design and database creation of the LEVÂİC Application belong to the Service Provider. Copying or using the website, software, and related rights, and subjecting the software and technologies used to reverse engineering processes, is strictly prohibited.

14. LEVÂİC SERVICE RESPONSIBILITIES

As a service company, LEVÂİC is responsible for the laws of the countries and regions in which it operates, does not engage in actions contrary to the law, and expects the same from its Users. Users who act contrary to country/region laws shall have their relationship with LEVÂİC terminated and the relevant institutions/organizations/authorities shall be informed. Although User feedback and expectations are important to LEVÂİC, LEVÂİC reserves the right to determine its service principles and limits. It has no responsibility beyond legal agreements and provides no guarantees. Interruptions may occur in the services provided by LEVÂİC. Interruptions may not be resolved. The information you obtain may contain inaccuracies. LEVÂİC does not provide any guarantee to the User that such issues will not occur.

The User declares the accuracy of all information they provide and choose to publish throughout the LEVÂİC experience and is held responsible for the consequences. Although LEVÂİC accepts only adults as Users and takes security measures, it is not responsible for any User and does not guarantee that you will not experience negative interactions with other individuals.

LEVÂİC may provide or request suggestions, comments, inputs, or other feedback related to the Service. If the User provides any feedback to LEVÂİC, the User grants LEVÂİC a perpetual, irrevocable, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, publicly display, distribute, and modify such feedback. The User provides any feedback entirely voluntarily. The User accepts that they will not receive any compensation for feedback and that LEVÂİC may use any feedback provided by the User to improve LEVÂİC services or to develop new features and services.

15. ACCESSIBLE THIRD-PARTY SERVICES

Advertisements and promotions offered by third parties are not within the scope of LEVÂİC. Therefore, LEVÂİC is not responsible for their usage processes and results. It is the User’s own preference to use those services. If the User chooses to use them, the User is subject not to LEVÂİC’s terms but to the contract and conditions of the institution providing that service.

16. LIMITATION OF LIABILITY

• In cases where you can or cannot access LEVÂİC services via internet, telephone, email, or any other means, and whether you use or do not use the services you may receive

• In your interactions with other Users, third parties, or services under LEVÂİC, including their behavior and attitudes, your agreements with them, and your experiences with them

• In cases of illegal access to your data, copyright infringement of your data, and modifications made to your data as a result of access

The LEVÂİC team and company are not responsible for your monetary, profit, data, usage, moral, or other losses and damages. Measures are taken to prevent such losses and damages, but it is not guaranteed that you will not experience them.

LEVÂİC’S TOTAL LIABILITY TO YOU FOR CLAIMS RELATED TO THE SERVICE SHALL NEVER EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE AND 100 USD DOLLARS DURING THE PERIOD YOU HAVE AN ACCOUNT.

Depending on the region and country under whose laws the User is subject, damage laws may vary. LEVÂİC is obligated to comply with the laws and regulations of the region and country in which it is located. A decision rendered under applicable law is also accepted by LEVÂİC. For this reason, regional/national differences in this Agreement are considered exceptional acceptances.

17. CONFIDENTIALITY

17.1 Users agree that all information they provide within the scope of the LEVÂİC Application constitutes confidential information (“Confidential Information”). The Service Provider declares and accepts that it will not disclose Users’ profile and session data recorded according to Users’ preferences to any third parties other than Consultants within the scope permitted by the Users, and that it will take all necessary measures to ensure the confidentiality of such Confidential Information.

17.2 Within the scope of this Agreement, the confidentiality provisions shall not apply in cases where the information disclosed by Users:

(a) becomes public knowledge now or later without the negligence or fault of the receiving party;

(b) was already known by the receiving party before disclosure by the disclosing party;

(c) is disclosed or provided by a third party who legally has the right to disclose the Confidential Information;

(d) is disclosed or provided pursuant to applicable legal regulations, a court decision, or an administrative order.

17.3 The confidentiality obligation regulated in Article 16 of this Agreement shall remain valid even if the Agreement is terminated for any reason.

18. GOVERNING LAW

This Agreement is subject to the laws of the State of Delaware. The parties shall first endeavor to resolve any disputes arising from the implementation of this Agreement amicably between themselves. For disputes that cannot be resolved amicably, the parties accept and declare that the laws and courts of the State of Delaware shall have exclusive jurisdiction.

19. TERMINATION

As the Service Provider, LEVÂİC may prohibit Users from using and accessing the application, suspend profiles, or temporarily discontinue use without having to provide any reason if it is determined that Users have violated this Agreement or to the extent required by the circumstances.

20. ASSIGNMENT

Users may not assign any of their rights or obligations under this Agreement.

21. YOUR INDEMNIFICATION TO THE COMPANY

In cases where Users access LEVÂİC services via internet, telephone, email, or any other means and use the services they may receive, and in cases where they act contrary to LEVÂİC rules and agreements, commit violations, and as a result any declarations, objections, claims, debts, losses, damages, costs, and payments occur; Users accept to indemnify and hold harmless the LEVÂİC team and company and to compensate for damages.

22. MISCELLANEOUS

This Agreement constitutes the entire agreement including Security and Policy, Site Security, Cookie Policy, Safety Tips and Code of Conduct, and agreements covering LEVÂİC in-app purchases, extra products, goods, content, features, and services. Each article of the Agreement is both independent and binding. In case of violation or cancellation of any article(s), the remaining articles shall remain valid. The occurrence of exceptional circumstances and LEVÂİC company’s failure to enforce any article(s) shall not constitute a waiver of the provisions and rights of that article.

23. EFFECTIVENESS

This Agreement shall remain in effect as long as the application continues to be used and no new agreement is presented by the Service Provider. If you approve the principles written above, you shall be deemed to have accepted and approved all services you receive from the LEVÂİC application and all information and responsibilities contained in this text for the duration of national measures.
